  1.1                          A bill for an act 
  1.2             relating to recreational vehicles; prohibiting the use 
  1.3             of metal traction devices on paved public trails; 
  1.4             requiring a metal traction device sticker; 
  1.5             appropriating money; proposing coding for new law in 
  1.6             Minnesota Statutes, chapter 84; repealing Minnesota 
  1.7             Statutes 1998, section 84.871, subdivision 2; and Laws 
  1.8             1998, chapter 401, section 23. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  [84.8712] [METAL TRACTION DEVICES; PROHIBITION 
  1.11  ON PAVED TRAILS.] 
  1.12     A person may not use a snowmobile with metal traction 
  1.13  devices on a paved public trail, except as otherwise provided by 
  1.14  a local government with jurisdiction over a trail or where paved 
  1.15  connections exist between nonpaved snowmobile trails. 
  1.16     Sec. 2.  [84.8713] [METAL TRACTION DEVICE STICKER.] 
  1.17     Subdivision 1.  [STICKER REQUIRED; FEE.] (a) An owner of a 
  1.18  snowmobile registered in the state may not operate the 
  1.19  snowmobile with a track equipped with metal traction devices 
  1.20  unless a metal traction device sticker is affixed to the 
  1.21  snowmobile.  The commissioner shall issue a metal traction 
  1.22  device sticker upon application and payment of a $10 fee.  The 
  1.23  sticker is valid for one year following June 30 in the year it 
  1.24  is issued.  
  1.25     (b) Fees collected under this section shall be deposited in 
  1.26  the state treasury and credited to the snowmobile trails and 
  1.27  enforcement account in the natural resources fund.  Money 
  2.1   deposited under this section must be used for repair of paved 
  2.2   public trails, unless a trail is exempted by local authorities 
  2.3   under section 84.8712, except that any money not necessary for 
  2.4   this purpose may be used for the grant-in-aid snowmobile trail 
  2.5   system. 
  2.6      Subd. 2.  [PLACEMENT OF STICKER.] The metal traction device 
  2.7   sticker must be permanently affixed to the forward half of the 
  2.8   snowmobile and clearly visible to law enforcement authorities. 
  2.9      Subd. 3.  [LICENSE AGENTS.] The commissioner shall sell 
  2.10  metal traction device stickers for a $1 issuance fee through the 
  2.11  process established under section 84.82, subdivision 2. 
  2.12     Subd. 4.  [REPEALER.] This section is repealed on July 1, 
  2.13  2004. 
  2.14     Sec. 3.  [APPROPRIATION.] 
  2.15     $....... is appropriated from the natural resources fund 
  2.16  from the sale of metal traction device stickers under Minnesota 
  2.17  Statutes, section 84.8715 to the commissioner of natural 
  2.18  resources for the repair of state trails damaged by snowmobiles. 
  2.19     Sec. 4.  [REPEALER.] 
  2.20     Minnesota Statutes 1998, section 84.871, subdivision 2; and 
  2.21  Laws 1998, chapter 401, section 23, are repealed.
