  1.1                          A bill for an act
  1.2             relating to drivers' licenses; allowing exemption from 
  1.3             commercial driver's license requirement for certain 
  1.4             snowplow operators; amending Minnesota Statutes 1996, 
  1.5             section 171.02, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 171.02, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 5.  [EXEMPTION FOR CERTAIN BACKUP SNOWPLOW 
  1.10  DRIVERS.] Pursuant to the waiver authorization set forth in 
  1.11  Public Law Number 104-59, section 345 (a)(5), a person who 
  1.12  operates a commercial motor vehicle for the purpose of removing 
  1.13  snow or ice from a roadway by plowing, salting, or sanding is 
  1.14  not required to hold a commercial driver's license if the person:
  1.15     (1) is an employee of a local unit of government with a 
  1.16  population of 3,000 or less; 
  1.17     (2) is operating within the boundaries of the local unit of 
  1.18  government; 
  1.19     (3) holds a valid driver's license authorizing the 
  1.20  operation of class B vehicles; and 
  1.21     (4) except in the event of a lawful strike, is temporarily 
  1.22  replacing the employee who normally operates the vehicle but 
  1.23  either is unable to operate the vehicle or is in need of 
  1.24  additional assistance due to a snow emergency as determined by 
  1.25  the local unit of government. 
  2.1      Sec. 2.  [EFFECTIVE DATE.] 
  2.2      Section 1 is effective the day following final enactment.
