  1.1                          A bill for an act 
  1.2             relating to criminal justice; providing for community 
  1.3             service in lieu of criminal fines in certain 
  1.4             instances; amending Minnesota Statutes 2000, section 
  1.5             609.101, subdivision 5. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 609.101, 
  1.8   subdivision 5, is amended to read: 
  1.9      Subd. 5.  [WAIVER PROHIBITED; REDUCTION AND INSTALLMENT 
  1.10  PAYMENTS.] (a) The court may not waive payment of the minimum 
  1.11  fine required by this section.  
  1.12     (b) If the defendant qualifies for the services of a public 
  1.13  defender or the court finds on the record that the convicted 
  1.14  person is indigent or that immediate payment of the fine would 
  1.15  create undue hardship for the convicted person or that person's 
  1.16  immediate family, the court may permit the defendant to 
  1.17  participate in a community work service program to work off the 
  1.18  fine at the rate of $5 per hour.  If the defendant is disabled 
  1.19  or ill and lacks an ability to participate in a community work 
  1.20  service program, the court may reduce the amount of the minimum 
  1.21  fine to not less than $50.  
  1.22     (c) The court also may authorize payment of the fine in 
  1.23  installments. 
  1.24     Sec. 2.  [EFFECTIVE DATE.] 
  1.25     Section 1 is effective August 1, 2001, and applies to 
  2.1   crimes committed on or after that date.
