  1.1                          A bill for an act 
  1.2             relating to state lands; providing for certain state 
  1.3             land acquisition; modifying the Mississippi whitewater 
  1.4             trail; modifying provisions of the outdoor recreation 
  1.5             system; establishing a mineral coordinating committee; 
  1.6             adding to and deleting from state parks, state 
  1.7             recreation areas, state forests, and wildlife 
  1.8             management areas; authorizing public and private sales 
  1.9             and conveyances of certain state lands; requiring 
  1.10            certain land exchanges; amending Minnesota Statutes 
  1.11            2002, sections 85.013, subdivision 1; 85.0156, 
  1.12            subdivision 1; 86A.04; proposing coding for new law in 
  1.13            Minnesota Statutes, chapter 93. 
  1.14  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.15     Section 1.  Minnesota Statutes 2002, section 85.013, 
  1.16  subdivision 1, is amended to read: 
  1.17     Subdivision 1.  [NAMES, ACQUISITION; ADMINISTRATION.] State 
  1.18  parks, (a) Designated monuments, recreation reserves, and 
  1.19  waysides heretofore established and hereby confirmed as state 
  1.20  monuments, state recreation areas and state waysides together 
  1.21  with the counties in which they are situated are listed in this 
  1.22  section and shall hereafter be named as indicated in this 
  1.23  section.  
  1.24     (b) Any land that now is or hereafter becomes tax-forfeited 
  1.25  land and is located within the described boundaries of a state 
  1.26  recreation area as defined by session laws is hereby withdrawn 
  1.27  from sale and is transferred from the custody, control, and 
  1.28  supervision of the county board of the county to the 
  1.29  commissioner of natural resources, free from any trust in favor 
  2.1   of the interested taxing districts.  The commissioner shall 
  2.2   execute a certificate of acceptance of the lands on behalf of 
  2.3   the state for such purposes and transmit the same to the county 
  2.4   auditor of the county for record as provided by law in the case 
  2.5   of tax-forfeited land transferred to the commissioner by 
  2.6   resolution of the county board for conservation purposes. 
  2.7      Sec. 2.  Minnesota Statutes 2002, section 85.0156, 
  2.8   subdivision 1, is amended to read: 
  2.9      Subdivision 1.  [CREATION.] An urban whitewater trail is 
  2.10  created along the Mississippi river in the lower St. Anthony 
  2.11  falls area below the stone arch bridge in Minneapolis.  The 
  2.12  trail must be primarily developed for whitewater rafters, 
  2.13  canoers, and kayakers. 
  2.14     Sec. 3.  Minnesota Statutes 2002, section 86A.04, is 
  2.15  amended to read: 
  2.16     86A.04 [COMPOSITION OF SYSTEM.] 
  2.17     The outdoor recreation system shall consist of all state 
  2.18  parks; state recreation areas; state trails established pursuant 
  2.19  to sections 84.029, subdivision 2, and 85.015, 85.0155, and 
  2.20  85.0156; state scientific and natural areas; state wilderness 
  2.21  areas; state forests; state wildlife management areas; state 
  2.22  water access sites, which include all lands and facilities 
  2.23  established by the commissioner of natural resources or the 
  2.24  commissioner of transportation to provide public access to 
  2.25  water; state wild, scenic, and recreational rivers; state 
  2.26  historic sites; state rest areas, which include all facilities 
  2.27  established by the commissioner of transportation for the 
  2.28  safety, rest, comfort and use of the highway traveler, and shall 
  2.29  include all existing facilities designated as rest areas and 
  2.30  waysides by the commissioner of transportation; and any other 
  2.31  units not listed in this section that are classified under 
  2.32  section 86A.05.  Each individual state park, state recreation 
  2.33  area, and so forth is called a "unit." 
  2.34     Sec. 4.  [93.0015] [MINERAL COORDINATING COMMITTEE.] 
  2.35     Subdivision 1.  [ESTABLISHMENT; MEMBERSHIP.] The mineral 
  2.36  coordinating committee is established to plan for diversified 
  3.1   mineral development.  The mineral coordinating committee 
  3.2   consists of: 
  3.3      (1) the commissioner of natural resources; 
  3.4      (2) the deputy commissioner of the Minnesota pollution 
  3.5   control agency; 
  3.6      (3) the director of United Steelworkers of America, 
  3.7   district 11, or the director's designee; 
  3.8      (4) the commissioner of iron range resources and 
  3.9   rehabilitation; 
  3.10     (5) the director of the Minnesota geological survey; 
  3.11     (6) the dean of the University of Minnesota institute of 
  3.12  technology; 
  3.13     (7) the director of the natural resources research 
  3.14  institute; and 
  3.15     (8) three individuals appointed by the governor for a 
  3.16  four-year term, one each representing the iron ore and taconite, 
  3.17  nonferrous metallic minerals, and industrial minerals industries 
  3.18  within the state. 
  3.19     Subd. 2.  [STAFFING.] The commissioner of natural resources 
  3.20  shall serve as chair of the committee.  A member of the 
  3.21  committee may designate another person of the member's 
  3.22  organization to act in the member's place.  The commissioner 
  3.23  shall provide staff and administrative services necessary for 
  3.24  the committee's activities. 
  3.25     Subd. 3.  [EXPIRATION.] Notwithstanding section 15.059, 
  3.26  subdivision 5, or other law to the contrary, the committee 
  3.27  expires June 30, 2007.  
  3.28     Subd. 4.  [ADVICE.] The mineral coordinating committee is 
  3.29  encouraged to solicit and receive advice from representatives of 
  3.30  the United States Geological Survey, United States Environmental 
  3.31  Protection Agency, and United States Department of Energy. 
  3.32     Sec. 5.  [ADDITIONS TO STATE PARKS.] 
  3.33     Subdivision 1.  [85.012] [Subd. 18.] [FORT SNELLING STATE 
  3.34  PARK, RAMSEY, HENNEPIN, AND DAKOTA COUNTIES.] The following 
  3.35  areas are added to Ft. Snelling state park, Dakota and Hennepin 
  3.36  counties: 
  4.1      (1) the following is in Section 18, Township 27 North, 
  4.2   Range 23 West, Dakota county:  that part of Government Lot 8, 
  4.3   according to the Government Survey thereof, described as 
  4.4   follows:  commencing at the southwest corner of said Government 
  4.5   Lot 8; thence on an assumed bearing of South 88 degrees 21 
  4.6   minutes 46 seconds East, along the south line of said Government 
  4.7   Lot 8, a distance of 1287.93 feet to the actual point of 
  4.8   beginning of the property to be described; thence continuing 
  4.9   South 88 degrees 21 minutes 46 seconds East, along said south 
  4.10  line of Government Lot 8, a distance of 1055.38 feet to the 
  4.11  southwesterly right-of-way line of Cedar Avenue (Nicols Road);

 10.11     (a) Notwithstanding Minnesota Statutes, sections 92.45 and 
 10.12  282.018, subdivision 1, Aitkin county may sell the tax-forfeited 
 10.13  land bordering public water that is described in paragraph (c), 
 10.14  under the remaining provisions of Minnesota Statutes, chapter 
 10.15  282. 
 10.16     (b) The conveyance must be in a form approved by the 
 10.17  attorney general.  
 10.18     (c) The land to be sold is located in Aitkin county and is 
 10.19  described as: 
 10.20     Six acres in Government Lot 3 as in Document #198469 less 
 10.21  2.69 acres plat Section 24, Township 52, Range 26, more 
 10.22  accurately described as:  That part of Government Lot 3, Section 
 10.23  24, Township 52 North, Range 26 West, Aitkin County, Minnesota, 
 10.24  described as follows:  Commencing at the southwest corner of

 18.14  WATERS; SCOTT COUNTY.] 
 18.15     (a) Notwithstanding Minnesota Statutes, sections 92.45; 
 18.16  94.09; 94.10; 97A.135, subdivision 2a; and 103F.535, the 
 18.17  commissioner of natural resources shall sell by private sale the 
 18.18  surplus land bordering public waters that is described in 
 18.19  paragraph (e). 
 18.20     (b) The conveyance shall be in a form approved by the 
 18.21  attorney general for consideration of no less than the appraised 
 18.22  value of the land. 
 18.23     (c) The deed must contain a restrictive covenant that 
 18.24  prohibits altering, disturbing vegetation in, draining, filling, 
 18.25  or placing any material or structure of any kind on or in the 
 18.26  existing wetland area located on the land; prohibits any 
 18.27  increase in run-off rate or volume from the land or future 
 18.28  buildings into said wetland; and prohibits diverting or 
 18.29  appropriating water from said wetland. 
 18.30     (d) The consideration received for the conveyance shall be 
 18.31  deposited in the state treasury and credited to the wildlife 
 18.32  acquisition account in the game and fish fund.  The money is 
 18.33  appropriated to the commissioner of natural resources for 
 18.34  wildlife land acquisition purposes. 
 18.35     (e) The land that may be sold is in the Prior Lake wildlife 
 18.36  management area in Scott county and is described as: 
 19.1      The East 1200 feet of the South 800 feet of the Southwest 
 19.2      Quarter of the Southeast Quarter of Section 22, Township 
 19.3      115 North, Range 22 West.  Including the abandoned 
 19.4      right-of-way of the Chicago, Milwaukee, St. Paul and 
 19.5      Pacific Railroad Company (formerly the Hastings and Dakota 
 19.6      Railway Company).  Containing 22 acres, more or less. 
 19.7      (f) This land no longer fits into the state wildlife 
 19.8   management area system because of hunting limitations, its small 
 19.9   size, and future development planned for the area.  Proceeds 
 19.10  from the sale will be used to purchase lands more suitable for 
 19.11  wildlife management and public use. 
 19.12     Sec. 21.  [PRIVATE SALE OF SURPLUS STATE LAND BORDERING 
 19.13  PUBLIC WATERS; ST. LOUIS COUNTY.] 
 19.14     (a) Notwithstanding Minnesota Statutes, sections 92.45, 
 19.15  94.09, and 94.10, the commissioner of natural resources may sell 
 19.16  by private sale to adjacent landowners the surplus land 
 19.17  bordering public waters that is described in paragraph (c). 
 19.18     (b) The conveyance must be in a form approved by the 
 19.19  attorney general and the consideration must be equal to the fair 
 19.20  market value of the land plus the cost of appraisal. 
 19.21     (c) The land to be sold is in St. Louis county and is a 
 19.22  parcel of land to be split from Government Lot 5, Section 1, 
 19.23  Township 67 North, Range 17 West.  The exact area to be sold 
 19.24  will be determined by completion of a further site analysis. 
 19.25     (d) The conveyance is necessary for installation of a 
 19.26  community septic system to benefit the adjacent land owners in 
 19.27  Government Lot 6, Section 1, Township 67 North, Range 17 West. 
 19.28     (e) The commissioner has determined that the parcel needed 
 19.29  for the purpose described in paragraph (d) is available for 
 19.30  surplus, will not be necessary for natural resources purposes, 
 19.31  and is best suited for the above-stated purpose. 
 19.32     Sec. 22.  [PUBLIC OR PRIVATE SALE OF TAX-FORFEITED LAND 
 19.33  BORDERING PUBLIC WATER; ST. LOUIS COUNTY.] 
 19.34     (a) Notwithstanding Minnesota Statutes, sections 92.45 and 
 19.35  282.018, subdivision 1, and the public sale provisions of

 20.1   public or private sale the tax-forfeited land bordering public

 21.27  the commissioner in the exchange under paragraph (a) is 
 21.28  described as:  the Northeast Quarter of the Southwest Quarter, 
 21.29  Section 5, Township 167 North, Range 33 West. 
 21.30     Sec. 25.  [LAND EXCHANGE; ST. LOUIS COUNTY.] 
 21.31     Subdivision 1.  [EXCHANGE REQUIRED.] The commissioner of 
 21.32  natural resources shall exchange, according to Laws 1998, 
 21.33  chapter 389, article 16, section 31, as amended by Laws 1999, 
 21.34  chapter 184, Laws 2000, chapter 488, article 3, section 31, and 
 21.35  Laws 2001, chapter 164, section 5, the following trust fund land 
 21.36  in St. Louis county:  Lot 11, Block 1 of Lake Leander Homesite 
 22.1   Plat No. 1, Section 16, Township 60 North, Range 19 West, for 
 22.2   county land. 
 22.3      Subd. 2.  [DEADLINE.] The exchange required under 
 22.4   subdivision 1 must be completed by June 30, 2004. 
 22.5      Sec. 26.  [CONVEYANCE OF LAND; COOK COUNTY.] 
 22.6      (a) Notwithstanding Minnesota Statutes, sections 92.45, 
 22.7   94.09 to 94.16, 161.144, or any other law, the commissioner of 
 22.8   transportation shall convey to Cook county for no consideration 
 22.9   the land bordering public water that is described in paragraph 
 22.10  (c).  The commissioner may not convey the land until Cook county 
 22.11  enters into an agreement with the commissioner of transportation 
 22.12  to spend an amount equal to the value of the land described in 
 22.13  paragraph (c) for airport purposes.  The value of the land shall 
 22.14  be determined by a current appraisal. 
 22.15     (b) The conveyance must be in a form approved by the 
 22.16  attorney general and must convey the land free and clear of any 
 22.17  requirement to use the land for a particular purpose. 
 22.18     (c) The land to be conveyed is described as: 
 22.19     (1) all of Government Lots 1, 2, 10, 11, and 12 of Section 
 22.20  30, Township 62 North, Range 1 East of the Fourth Principal 
 22.21  Meridian, Cook county, Minnesota, according to plat of resurvey 
 22.22  accepted by the United States of America, Department of 
 22.23  Interior, Bureau of Land Management, on May 22, 1951, except the 
 22.24  land lying South and East of the following described line: 
 22.25     From the northwest corner of said Section 30, South 2 
 22.26  degrees 18 minutes East for a distance of 1758.9 feet to the 
 22.27  meander corner Sections 25 and 30 on the north shore of Devils 
 22.28  Track Lake; thence North 2 degrees 18 minutes West 26.4 feet to 
 22.29  a point on the section line; thence south 87 degrees 05 minutes 
 22.30  East for a distance of 646.8 feet; thence South 88.4 feet to a 
 22.31  point on the north shore of Devils Track Lake which is the point 
 22.32  of beginning of the line to be described herein; from said point 
 22.33  of beginning North for a distance of 88.4 feet; thence South 87 
 22.34  degrees 05 minutes East for a distance of 1442.8 feet; thence 
 22.35  South 100 feet; thence South 87 degrees 05 minutes East for a 
 22.36  distance of 947.1 feet to a point on the North-South quarter 
 23.1   line of said Section 30, said point being 124.1 feet South of 
 23.2   the center of Section 30, subject to reservation of the coal and 
 23.3   other minerals and conditions and limitations provided by the 
 23.4   Federal Act of December 22, 1928 (45 Stat., 1069); and 
 23.5      (2) that part of Government Lot 3, Section 30, Township 62 
 23.6   North, Range 1 East, Cook county, Minnesota, lying within the 
 23.7   following described lines: 
 23.8      Beginning at the northwest corner of Section 30, Township 
 23.9   62 North, Range 1 East, Cook county, thence South 02 degrees 00 
 23.10  minutes East for a distance of 1747 feet; thence South 87 
 23.11  degrees 05 minutes East for a distance of 2089.6 feet; thence 
 23.12  South for a distance of 100 feet; thence South 87 degrees 05 
 23.13  minutes East for a distance of 947.1 feet to a point on the 
 23.14  North-South quarter line of Section 30 which is the point of 
 23.15  beginning of the property to be described herein; from said 
 23.16  point of beginning thence South 87 degrees 05 minutes East for a 
 23.17  distance of 450 feet; thence North 01 degrees 38 minutes East 
 23.18  for a distance of 840 feet; thence North 87 degrees 05 minutes 
 23.19  West for a distance of 450 feet to a point on the North-South 
 23.20  quarter line of Section 30; thence South 01 degrees 38 minutes 
 23.21  West on said North-South quarter line for a distance of 840 feet 
 23.22  to the point of beginning. 
 23.23     Sec. 27.  [FOND DU LAC RESERVATION LANDS.] 
 23.24     Before offering state-owned lands for public sale under 
 23.25  Minnesota Statutes, sections 282.01 to 282.13, the county 
 23.26  auditor shall first offer lands within the Fond du Lac Indian 
 23.27  Reservation to the Fond du Lac Band of Chippewa Indians for sale 
 23.28  at the appraised value.  The costs of any survey or appraisal 
 23.29  must be added to and made a part of the appraised value.  To 
 23.30  determine whether the band wants to buy the land, the county 
 23.31  auditor shall give written notice to the band.  If the band 
 23.32  wants to buy the land, it shall submit a written offer to the 
 23.33  county auditor within two weeks after receiving the notice.  If 
 23.34  the offer is for at least the appraised value, including costs, 
 23.35  the county auditor shall accept it. 
 23.36     Sec. 28.  [EFFECTIVE DATE.] 
 24.1      (a) Section 27 is effective the day after the governing 
 24.2   body of Carlton county and its chief clerical officer timely 
 24.3   complete their compliance with Minnesota Statutes, section 
 24.4   645.021, subdivisions 2 and 3. 
 24.5      (b) Sections 13 and 25 are effective the day following 
 24.6   final enactment.
