  1.1                          A bill for an act 
  1.2             relating to gambling; authorizing fantasy sports 
  1.3             leagues; amending Minnesota Statutes 2002, section 
  1.4             609.761, by adding a subdivision. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2002, section 609.761, is 
  1.7   amended by adding a subdivision to read: 
  1.8      Subd. 6.  [FANTASY SPORTS LEAGUES.] Sections 609.755 and 
  1.9   609.76 do not prohibit a retail establishment licensed to sell 
  1.10  alcoholic beverages from conducting a fantasy sports league if 
  1.11  the following conditions are satisfied: 
  1.12     (1) the total value of payouts to all league members is 
  1.13  equal to the amount collected for entrance, administrative, and 
  1.14  transactions fees; 
  1.15     (2) the maximum payout to any single individual does not 
  1.16  exceed $50; and 
  1.17     (3) the retail establishment organizing the game has no 
  1.18  interest in the outcome of or participates financially in the 
  1.19  game. 
  1.20  This subdivision does not authorize the betting or wagering on 
  1.21  the outcome of an individual sporting event or activities 
  1.22  unlawful under section 609.76, subdivision 2. 
  1.23     Sec. 2.  [EFFECTIVE DATE.] 
  1.24     Section 1 is effective the day following final enactment.
