A bill for an act
relating to metropolitan government; authorizing annual audit of Metropolitan
Council by private certified public accountants; amending Minnesota Statutes
2008, section 473.13, subdivision 4.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 473.13, subdivision 4, is amended to read:


Subd. 4.

Accounts; audits.

The council shall keep an accurate account of its
receipts and disbursements. Disbursements of council money must be made by check
or by electronic funds transfer, signed or authorized by the chair or vice-chair of the
council, and countersigned or authorized by its regional administrator or designee after
whatever auditing and approval of the expenditure may be required by the council. The

new text end . new text begin If the audit is performed by the state auditor,
new text end the council shall pay to the state the total cost and expenses of the examination, including
the salaries paid to the auditors while actually engaged in making the examination. The
general fund must be credited with all collections made for any examinationnew text begin by the
state auditor
new text end .new text begin If the audit is performed by a private certified public accountant, the state
auditor may require additional information from the private certified public accountant
as the state auditor deems in the public interest. The state auditor may accept the audit
or make additional examinations as the state auditor deems to be in the public interest.
Data relating to an annual audit performed by a private certified public accountant are
protected nonpublic data or confidential data on individuals until the final report has been
published as provided in section 13.392.
