  1.1                          A bill for an act 
  1.2             relating to lotteries; requiring the director to 
  1.3             establish sports pool games; establishing a human 
  1.4             resources account in the general fund, to which all 
  1.5             net proceeds from these games must be credited; 
  1.6             appropriating money for nutrition, housing, and health 
  1.7             care; amending Minnesota Statutes 1994, sections 
  1.8             145A.14, by adding a subdivision; 349A.04; 349A.10, 
  1.9             subdivision 5; and 349A.13; proposing coding for new 
  1.10            law in Minnesota Statutes, chapters 16A; 256; and 268. 
  1.11  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.12     Section 1.  [16A.727] [HUMAN RESOURCES ACCOUNT.] 
  1.13     It is the policy of the state of Minnesota that no person 
  1.14  in the state should be homeless, hungry, or without health 
  1.15  care.  Therefore, a human resources account in the general fund 
  1.16  is created to meet these basic needs of the people of our 
  1.17  state.  The account consists of net proceeds from sports pool 
  1.18  games deposited in it under Minnesota Statutes, section 349A.10, 
  1.19  subdivision 5. 
  1.20     Sec. 2.  Minnesota Statutes 1994, section 145A.14, is 
  1.21  amended by adding a subdivision to read: 
  1.22     Subd. 5.  [GRANTS FOR COMMUNITY HEALTH CLINICS.] The 
  1.23  commissioner of health may make special grants to community 
  1.24  health boards or nonprofit corporations to establish, operate, 
  1.25  or subsidize clinic facilities and services, including mobile 
  1.26  clinics, to provide community health services in areas of the 
  1.27  state where there are inadequate facilities and services to 
  1.28  serve populations with particular health care needs, such as the 
  2.1   homeless population. 
  2.2      Applicants for grants under this subdivision must submit to 
  2.3   the commissioner for approval a plan and budget for use of the 
  2.4   funds in the form and detail required by the commissioner.  
  2.5   Recipients of funds under this subdivision must provide the 
  2.6   services required by the commissioner.  They must report to the 
  2.7   commissioner at least annually on the use of the funds.  
  2.8   Recipients of funds under this subdivision must keep records, 
  2.9   including records of expenditure of funds, required by the 
  2.10  commissioner.  The commissioner may audit the records to 
  2.11  determine eligibility for funds under this subdivision. 
  2.12     Sec. 3.  [256.922] [APPROPRIATIONS FROM ACCOUNT.] 
  2.13     The funds in the human resources account created in section 
  2.14  1 are annually appropriated as follows: 
  2.15     (1) one-third to the housing trust fund account in the 
  2.16  housing development fund created under section 462A.201, for use 
  2.17  by the housing finance agency for the purposes given in section 
  2.18  462A.201, subdivisions 2 and 3; 
  2.19     (2) one-third to the commissioner of jobs and training for 
  2.20  supplemental food grants under section 268.44; and 
  2.21     (3) one-third to the commissioner of health for grants 
  2.22  under section 145A.14, subdivision 5. 
  2.23     Sec. 4.  [268.44] [GRANTS TO FOODSHELVES.] 
  2.24     Subdivision 1.  [GRANTS.] The commissioner of jobs and 
  2.25  training may provide grants to community foodshelves or other 
  2.26  nonprofit programs distributing food or meals without charge to 
  2.27  individuals or families in need. 
  2.28     Subd. 2.  [APPLICATION AND REPORTS.] Applicants for grants 
  2.29  under this section must submit to the commissioner for approval 
  2.30  a plan and budget for use of the funds in the form and detail 
  2.31  required by the commissioner.  Recipients of funds under this 
  2.32  section must provide food or meals as required by the 
  2.33  commissioner.  They must report to the commissioner at least 
  2.34  annually on the use of the funds.  Recipients of funds under 
  2.35  this section must keep records, including records of expenditure 
  2.36  of funds provided by the commissioner.  The commissioner may 
  3.1   audit the records to determine eligibility for funds under this 
  3.2   section. 
  3.3      Subd. 3.  [RULES.] The commissioner may adopt rules setting 
  3.4   eligibility criteria for recipients and for use of grant funds. 
  3.5      Sec. 5.  Minnesota Statutes 1994, section 349A.04, is 
  3.6   amended to read: 
  3.7      349A.04 [LOTTERY GAME PROCEDURES.] 
  3.8      Subdivision 1.  [GENERALLY.] The director may adopt game 
  3.9   procedures governing the following elements of the lottery: 
  3.10     (1) lottery games; 
  3.11     (2) ticket prices; 
  3.12     (3) number and size of prizes; 
  3.13     (4) methods of selecting winning tickets; and 
  3.14     (5) frequency and method of drawings. 
  3.15     Subd. 2.  [SPORTS POOL GAMES.] The director shall adopt 
  3.16  game procedures for a game or games based upon the results of 
  3.17  sporting events. 
  3.18     Subd. 3.  [ADMINISTRATIVE PROCEDURES EXEMPTION.] The 
  3.19  adoption of lottery game procedures is not subject to chapter 
  3.20  14.  Before adopting a lottery game procedure, the director 
  3.21  shall submit the procedure to the board for its review and 
  3.22  comment. 
  3.23     Sec. 6.  Minnesota Statutes 1994, section 349A.10, 
  3.24  subdivision 5, is amended to read: 
  3.25     Subd. 5.  [DEPOSIT OF NET PROCEEDS.] Within 30 days after 
  3.26  the end of each month, the director shall deposit in the state 
  3.27  treasury the net proceeds of the lottery, which is the balance 
  3.28  in the lottery fund after transfers to the lottery prize fund 
  3.29  and credits to the lottery operations account.  Of the net 
  3.30  proceeds other than net proceeds from sports pool games, 40 
  3.31  percent must be credited to the Minnesota environment and 
  3.32  natural resources trust fund, and the remainder must be credited 
  3.33  to the general fund.  The net proceeds from all sports pool 
  3.34  games must be credited to the human resources account created in 
  3.35  section 1. 
  3.36     Sec. 7.  Minnesota Statutes 1994, section 349A.13, is 
  4.1   amended to read: 
  4.2      349A.13 [RESTRICTIONS.] 
  4.3      Nothing in this chapter: 
  4.4      (1) authorizes the director to conduct a lottery game or 
  4.5   contest the winner or winners of which are determined by the 
  4.6   result of a sporting event other than a horse race conducted 
  4.7   under chapter 240; 
  4.8      (2) authorizes the director to install or operate a lottery 
  4.9   device operated by coin or currency which when operated 
  4.10  determines the winner of a game; and 
  4.11     (3) (2) authorizes the director to sell pull-tabs as 
  4.12  defined under section 349.12, subdivision 32. 
  4.13     Sec. 8.  [EFFECTIVE DATE.] 
  4.14     Sections 1 to 7 are effective the day following final 
  4.15  enactment.
