  1.1                          A bill for an act 
  1.2             relating to railroads; requiring the St. Louis and 
  1.3             Lake counties regional rail authority to grant a 
  1.4             certain easement across its right-of-way. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [RAILROAD TO GRANT EASEMENT.] 
  1.7      (a) Notwithstanding any other law, the St. Louis and Lake 
  1.8   counties regional rail authority shall grant a permanent 
  1.9   easement for a single driveway crossing of up to 20 feet in 
  1.10  width across the authority's railroad right-of-way at or near 
  1.11  Lakefront Line railroad station No. 575+00, to provide vehicular 
  1.12  access to the following real property:  lots 1 through 6, Jensen 
  1.13  Garden Tracts, Lakewood township. 
  1.14     (b) The easement must remain in effect as long as the 
  1.15  following conditions are met: 
  1.16     (1) the crossing is constructed and maintained by the owner 
  1.17  or owners of the property described in paragraph (a), at their 
  1.18  expense, so that it does not unreasonably impede the use of the 
  1.19  right-of-way for railroad purposes and does not create a hazard 
  1.20  to persons or property; and 
  1.21     (2) the owner or owners of the property described in 
  1.22  paragraph (a) take reasonable measures to prevent use of the 
  1.23  crossing by the general public. 
  1.24     (c) The authority must not impose a license fee or other 
  1.25  charge for the easement. 
  2.1      Sec. 2.  [EFFECTIVE DATE.] 
  2.2      Section 1 is effective June 1, 1999.
