  1.1                          A bill for an act 
  1.2             relating to state government; repealing the law 
  1.3             requiring the commissioner of administration to 
  1.4             provide duplicating and printing services; authorizing 
  1.5             outside contracts for these services; amending 
  1.6             Minnesota Statutes 2002, section 268.186; proposing 
  1.7             coding for new law in Minnesota Statutes, chapter 16C; 
  1.8             repealing Minnesota Statutes 2002, section 16B.50. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  [16C.091] [PRINTING SERVICES.] 
  1.11     Sections 16C.07; 16C.08, subdivision 2, clause (1); 16C.09, 
  1.12  paragraphs (a), clause (1), and (b); and 43A.047 do not apply to 
  1.13  contracts for printing or duplicating services. 
  1.14     Sec. 2.  Minnesota Statutes 2002, section 268.186, is 
  1.15  amended to read: 
  1.16     268.186 [RECORDS.] 
  1.17     (a) Each employer shall keep true and accurate records for 
  1.18  the periods of time and containing the information the 
  1.19  commissioner may require.  For the purpose of administering this 
  1.20  chapter, the commissioner has the power to examine, or cause to 
  1.21  be supplied or copied, any books, correspondence, papers, 
  1.22  records, or memoranda that are relevant, whether the books, 
  1.23  correspondence, papers, records, or memoranda are the property 
  1.24  of or in the possession of the employer or any other person at 
  1.25  any reasonable time and as often as may be necessary. 
  1.26     (b) The commissioner may make summaries, compilations, 
  1.27  photographs, duplications, or reproductions of any records, or 
  2.1   reports that the commissioner considers advisable for the 
  2.2   preservation of the information contained therein.  Any 
  2.3   summaries, compilations, photographs, duplications, or 
  2.4   reproductions shall be admissible in any proceeding under this 
  2.5   chapter.  Regardless of any restrictions contained in section 
  2.6   16B.50, The commissioner may duplicate records, reports, 
  2.7   summaries, compilations, instructions, determinations, or any 
  2.8   other written or recorded matter pertaining to the 
  2.9   administration of this chapter. 
  2.10     (c) Regardless of any law to the contrary, the commissioner 
  2.11  may provide for the destruction of any records, reports, or 
  2.12  reproductions thereof, or other papers, that are more than two 
  2.13  years old, and that are no longer necessary for determining 
  2.14  employer liability or an applicant's unemployment benefit rights 
  2.15  or for the administration of this chapter, including any 
  2.16  required audit.  The commissioner may provide for the 
  2.17  destruction or disposition of any record, report, or other paper 
  2.18  that has been photographed, duplicated, or reproduced. 
  2.19     Sec. 3.  [REPEALER.] 
  2.20     Minnesota Statutes 2002, section 16B.50, is repealed. 
  2.21     Sec. 4.  [EFFECTIVE DATE.] 
  2.22     Sections 1 to 3 are effective the day following final 
  2.23  enactment.
