  1.1                          A bill for an act
  1.2             relating to health; requiring the commissioner of 
  1.3             health to seek federal law changes related to the 
  1.4             frequency of physician evaluations and to the use of 
  1.5             the minimum data set in nursing homes. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [FEDERAL LAW CHANGE; FREQUENCY OF PHYSICIAN 
  1.8   EVALUATIONS.] 
  1.9      The commissioner of health, in cooperation with the 
  1.10  Minnesota congressional delegation, shall seek any federal law 
  1.11  changes necessary to reduce the frequency of physician 
  1.12  evaluations required under medical assistance, so that residents 
  1.13  in nursing homes are required to be evaluated by a physician at 
  1.14  least once during the first 30 days following admission, and 
  1.15  then whenever medically necessary. 
  1.16     Sec. 2.  [FEDERAL LAW CHANGE; MINIMUM DATA SET.] 
  1.17     The commissioner of health, in cooperation with the 
  1.18  Minnesota congressional delegation, shall seek any waivers or 
  1.19  federal law changes necessary to exempt Minnesota nursing homes 
  1.20  from all requirements related to the use of the minimum data set 
  1.21  to collect resident data. 
  1.22     Sec. 3.  [EFFECTIVE DATE.] 
  1.23     Sections 1 and 2 are effective the day following final 
  1.24  enactment.
