A bill for an act
relating to drivers' licenses; expanding same-day issuance of noncompliant drivers'
licenses, instruction permits, and identification cards; instituting requirements for
licenses and identification cards issued the same day; specifying locations where
same-day drivers' licenses will be offered; requiring a report; appropriating money.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin DRIVER'S LICENSE SAME-DAY ISSUANCE PILOT PROJECT
EXPANSION.

new text begin The commissioner of public safety must expand
the same-day driver's license pilot project established in Laws 2021, First Special Session
chapter 5, article 4, section 141, and conduct the pilot project under the requirements set
forth in this section.

new text begin (a) The commissioner must continue the same-day issuance pilot
project in Lakeville and Moorhead. The pilot project must be offered at the following
additional locations:

new text begin (1) Blaine;
new text end

new text begin (2) Brainerd;
new text end

new text begin (3) Chaska;
new text end

new text begin (4) Grand Rapids;
new text end

new text begin (5) Mankato;
new text end

new text begin (6) Minneapolis;
new text end

new text begin (7) Rochester;
new text end

new text begin (8) St. Paul;
new text end

new text begin (9) Stillwater; and
new text end

new text begin (10) Willmar.

new text begin (b) The pilot project locations established in paragraph (a) include any driver's license
agent in the city that requests to participate in the pilot project. The requirements of this
section apply to any driver's license agent participating in the pilot project.

new text begin (c) For paragraph (a), clauses (6), (7), and (8), the Department of Public Safety Division
of Driver and Vehicle Services (DVS) must select the location in the specified city where
the same-day issuance pilot project will be offered.

new text begin (a) An applicant who submits a properly completed
application for a noncompliant driver's license, instruction permit, or identification card
must be provided with the license or card at the time of application. The noncompliant
license or card must be processed and produced at the site of the application. The applicant
must not be required to go to another location to receive the license or card. The applicant
must not be provided with a temporary license or card.

new text begin (b) The commissioner must provide additional same-day services under the requirements
of this section at pilot project locations, including:

new text begin (1) providing an application for a duplicate noncompliant driver's license, instruction
permit, or identification card; and
new text end

new text begin (2) processing the renewal of a noncompliant driver's license, instruction permit, or
identification card.

new text begin Subd. 4. new text end

new text begin Design and construction. new text end

new text begin (a) The design and construction of a noncompliant
driver's license, instruction permit, or identification card issued under the pilot project must
be substantially similar to centrally issued drivers' licenses, instruction permits, or
identification cards issued under Minnesota Statutes, chapter 171.

new text begin (b) A same-day noncompliant driver's license, instruction permit, or identification card
must, as much as practicable, contain the same security features as centrally issued
noncompliant drivers' licenses, identification cards, or instruction permits. The security
features of a same-day noncompliant driver's license, instruction permit, or identification
card must not obscure the colored photograph of the licensee.

new text begin (c) To the extent practicable, the materials used in printing the noncompliant driver's
license, instruction permit, or identification card must be substantially similar to and must
not have significant differences in weight, thickness, or rigidity when compared to centrally
issued licenses or cards.

new text begin (a) The commissioner must establish and create informational
materials to raise public awareness about the pilot project. The commissioner must develop
a communications strategy that informs the public, deputy registrars, driver's license agents,
the hospitality industry, restaurant and beverage associations, financial institutions, law
enforcement agencies, state agencies, neighboring states, airports, car rental agencies, the
Transportation Security Administration, and any other public-facing entity that requires a
person to present identification about the same-day pilot project and its requirements.

new text begin (b) The commissioner must establish a pilot project web page on the DVS main website
and prominently identify information about the pilot project. The commissioner must present
information about the same-day pilot project, the locations of where the pilot project is
being offered, the same-day services located at those locations, a list of frequently asked
questions, and any other material needed to educate the public.

new text begin The commissioner must establish administrative processes at
DVS to review and facilitate the same-day pilot project. The processes established under
this subdivision must allow DVS to resolve outstanding issues or concerns about an
application for a same-day noncompliant driver's license, instruction permit, or identification
card in a timely manner. DVS must ensure that the administrative processes to resolve issues
with the pilot project at its central office are available five days a week and between the
hours of 9:00 a.m. and 7:30 p.m.

new text begin By January 1, 2026, the commissioner must submit a report on the
pilot project to the chairs and ranking minority members of the legislative committees with
jurisdiction over transportation policy and finance. At a minimum, the report must include
the following:

new text begin (1) a description of the pilot project and the locations that participated in the pilot project;
new text end

new text begin (2) a review of security features and a comparison of a centrally issued noncompliant
driver's license, instruction permit, or identification card versus a noncompliant driver's
license, instruction permit, or identification card issued under this section;
new text end

new text begin (3) a description and information on the commissioner's marketing and public awareness
campaign about the same-day pilot project;
new text end

new text begin (4) how many same-day noncompliant drivers' licenses, instruction permits, or
identification cards were processed during the pilot project;
new text end

new text begin (5) any information or feedback from the driver's license agents about the pilot project
in the additional locations specified in subdivision 2, paragraph (a); and
new text end

new text begin (6) recommendations on implementing same-day license issuance statewide.

new text begin EFFECTIVE DATE. new text end

new text begin This section is effective October 1, 2024, and applies to
applications received on or after that date.

Sec. 2. new text begin APPROPRIATION.
new text end

new text begin $....... is appropriated in fiscal year 2025 from the driver and vehicle services account
in the special revenue fund to the commissioner of public safety for expanding and
administering the same-day driver's license pilot project established in section 1. The
commissioner must use the funds appropriated under this section to:

new text begin (1) provide equipment and necessary capital improvements to driver's license agents at
the locations specified in section 1, subdivision 2, paragraph (a);
new text end

new text begin (2) enter into an agreement with a vendor for producing same-day noncompliant drivers'
licenses, identification cards, and instruction permits with substantially similar features as
required in section 1, subdivision 4; and
new text end

new text begin (3) provide staffing and overtime costs, including a position at DVS responsible for
administration of the same-day pilot project.
