A bill for an act
relating to commerce; creating a homeowner's association database; proposing
coding for new law in Minnesota Statutes, chapter 45.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin [45.60] DATABASE FOR COMMON INTEREST COMMUNITY.

new text begin (a) By ..., the Department of Commerce must establish a searchable database that contains
information regarding each common interest community, as defined in section 515B.1-103,
clause (10), operating within Minnesota. The database must be accessible on the common
interest community's webpage. The database must allow a user to search the name by which
a community is identified to find the common interest community that governs the
community. At a minimum, the database must include:

new text begin (1) the common interest community's legal name;

new text begin (2) the common interest community's federal employer identification number;
new text end

new text begin (3) the common interest community's mailing and physical address;
new text end

new text begin (4) the names, email addresses, and other contact information of the common interest
community's officers and directors;

new text begin (5) a copy of the common interest community's governing documents, including but not
limited to declarations, bylaws, rules, and any amendments;
new text end

new text begin (6) the total number of parcels in the common interest community; and
new text end

new text begin (7) the total amount of revenues and expenses from the common interest community's
annual budget.

new text begin (b) For common interest communities that are under the control of a developer, the
database must also include the following information:

new text begin (1) the developer's legal name;
new text end

new text begin (2) the developer's federal employer identification number; and
new text end

new text begin (3) the total number of parcels owned by the developer on the date of reporting.
