A bill for an act
relating to education; special education teacher licensing; proposing coding for
new law in Minnesota Statutes, chapter 122A.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

The Board of Teaching must issue an academic and
behavioral strategist license to special education teachers that meet the requirements
established by board rule. A teacher holding the academic and behavioral strategist license
is authorized to provide evaluation and specially designed instruction to eligible children
and youth with disabilities from kindergarten through age 21 who have a range of mild to
moderate needs in the areas of academics, behavior, social, emotional, communication, and
functional performance.

The academic and behavioral strategist license must be issued for a
term of five years, consistent with section 122A.18, subdivision 2, paragraph (c). The
academic and behavioral strategist license must be renewable in accordance with section
122A.18, subdivision 4, and any rules of the board applicable to other professional five-year
teaching licenses.

For purposes of this section, the board may use the expedited rulemaking
process under section 14.389.

A candidate that holds a valid academic and behavioral strategist license issued under
Minnesota Rules, part 8710.5050, at the time Minnesota Statutes, section 122A.34, is enacted
may apply for renewal of the academic and behavioral strategist license under Minnesota
Statutes, section 122A.34, subdivision 2.
