  1.1                          A bill for an act 
  1.2             relating to motor fuels; allowing sale or bulk 
  1.3             delivery of nonoxygenated gasoline for certain 
  1.4             purchasers; amending Minnesota Statutes 1998, section 
  1.5             239.791, subdivisions 1, 12, and by adding 
  1.6             subdivisions. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 239.791, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [MINIMUM OXYGEN CONTENT REQUIRED.] Except 
  1.11  as provided in subdivisions 10 to 12 14, a person responsible 
  1.12  for the product shall comply with the following requirements: 
  1.13     (a) After October 1, 1995, gasoline sold or offered for 
  1.14  sale at any time in a carbon monoxide control area must contain 
  1.15  at least 2.7 percent oxygen by weight. 
  1.16     (b) After October 1, 1997, all gasoline sold or offered for 
  1.17  sale in Minnesota must contain at least 2.7 percent oxygen by 
  1.18  weight. 
  1.19     Sec. 2.  Minnesota Statutes 1998, section 239.791, 
  1.20  subdivision 12, is amended to read: 
  1.21     Subd. 12.  [EXEMPTION FOR COLLECTOR VEHICLE AND OFF-ROAD 
  1.22  USE.] (a) Except during a carbon monoxide control period in a 
  1.23  carbon monoxide control area, A person responsible for the 
  1.24  product may offer for sale, sell, or dispense at a retail 
  1.25  gasoline station for use in collector vehicles or vehicles 
  1.26  eligible to be licensed as collector vehicles, off-road 
  2.1   vehicles, motorcycles, boats, snowmobiles, or small engines, 
  2.2   gasoline that is not oxygenated in accordance with subdivision 1 
  2.3   if the person meets the conditions in paragraphs (b) to (d).  If 
  2.4   the nonoxygenated gasoline is for use in a small engine, it must 
  2.5   be dispensed into a can with a capacity of six or fewer gallons. 
  2.6      (b) The nonoxygenated gasoline must be unleaded premium 
  2.7   grade as defined in section 239.751, subdivision 4. 
  2.8      (c) No more than one storage tank on the premises of the 
  2.9   retail gasoline station may be used for storage of the 
  2.10  nonoxygenated gasoline offered for sale, sold, or dispensed by 
  2.11  the station. 
  2.12     (d) The pump stands must be posted with a permanent notice 
  2.13  stating:  "NONOXYGENATED GASOLINE.  FOR USE IN COLLECTOR 
  2.14  VEHICLES OR VEHICLES ELIGIBLE TO BE LICENSED AS COLLECTOR 
  2.15  VEHICLES, OFF-ROAD VEHICLES, MOTORCYCLES, BOATS, SNOWMOBILES, OR 
  2.16  SMALL ENGINES ONLY." 
  2.17     Sec. 3.  Minnesota Statutes 1998, section 239.791, is 
  2.18  amended by adding a subdivision to read: 
  2.19     Subd. 13.  [EXEMPTION FOR CERTAIN RIPARIAN LANDOWNERS.] (a) 
  2.20  A person responsible for the product may offer for sale, sell, 
  2.21  and deliver directly to a bulk fuel storage tank gasoline that 
  2.22  is not oxygenated in accordance with subdivision 1 if the 
  2.23  conditions in paragraphs (b) to (e) are met. 
  2.24     (b) The nonoxygenated gasoline must be unleaded premium 
  2.25  grade as defined in section 239.751, subdivision 4. 
  2.26     (c) The bulk fuel storage tank must be stationary or 
  2.27  permanent. 
  2.28     (d) The bulk fuel storage tank must be under the control of 
  2.29  an owner of littoral or riparian property and located on that 
  2.30  littoral or riparian property. 
  2.31     (e) The nonoxygenated gasoline must be purchased for use in 
  2.32  vehicles that would qualify for an exemption under subdivision 
  2.33  12, paragraph (a). 
  2.34     Sec. 4.  Minnesota Statutes 1998, section 239.791, is 
  2.35  amended by adding a subdivision to read: 
  2.36     Subd. 14.  [EXEMPTION FOR AIRCRAFT OPERATORS.] A person 
  3.1   responsible for the product may offer for sale, sell, and 
  3.2   deliver directly to a bulk fuel storage tank gasoline that is 
  3.3   not oxygenated in accordance with subdivision 1 for use in 
  3.4   aircraft if the nonoxygenated gasoline is unleaded premium grade 
  3.5   as defined in section 239.751, subdivision 4. 
  3.6      Sec. 5.  [EFFECTIVE DATE.] 
  3.7      Sections 1 to 4 are effective the day following final 
  3.8   enactment.
