relating to consumer protection; establishing the Minnesota Kratom Consumer
Protection Act; authorizing administrative penalties; proposing coding for new
law in Minnesota Statutes, chapter 325F.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Sections 325F.996 to 325F.998 may be referred to as the "Minnesota Kratom Consumer
Protection Act."

Sec. 2.

new text begin [325F.996] DEFINITIONS.

new text begin Scope. new text end

new text begin For purposes of sections 325F.997 and 325F.998, the terms in
this section have the meanings given.

new text begin Commissioner. new text end

new text begin "Commissioner" means the commissioner of agriculture.

new text begin Dietary supplement. new text end

new text begin "Dietary supplement" has the meaning given in section
144G.08.

new text begin Kratom. new text end

new text begin "Kratom" means any part of the leaf of the plant Mitragyna Speciosa
and any mitragynine or 7-hydroxymitragynine alkaloid compounds derived from the leaf.

new text begin Kratom extract. new text end

new text begin "Kratom extract" means kratom that has been extracted and
concentrated to facilitate standardized dosing.

new text begin Kratom processor. new text end

new text begin "Kratom processor" means a person who manufactures or
prepares kratom extract or kratom product for sale to other kratom processors, distributors,
wholesalers, kratom retailers, or consumers.

new text begin Kratom product. new text end

new text begin "Kratom product" means a dietary supplement containing
kratom or kratom extract, whether manufactured as a powder, capsule, pill, beverage, or
other edible form.

new text begin Kratom retailer. new text end

new text begin "Kratom retailer" means a person who sells or offers for sale
kratom products to consumers.

new text begin Person. new text end

new text begin "Person" means any individual, firm, partnership, cooperative, society,
joint stock association, association, company, or corporation and includes any officer,
employee, agent, trustee, receiver, assignee, or other similar business entity or representative
of one of those entities.

Sec. 3.

new text begin [325F.997] PROHIBITED KRATOM EXTRACTS AND PRODUCTS.

new text begin Certain extracts and products prohibited. new text end

new text begin It is unlawful to manufacture,
prepare, distribute, sell, or offer for sale a kratom extract or kratom product identified in
this section.

new text begin Adulterated product. new text end

new text begin "Adulterated product" means a kratom product that is
adulterated with a dangerous nonkratom substance. A kratom product is adulterated with a
dangerous nonkratom substance if the kratom product is mixed or packed with a nonkratom
substance that affects the quality or strength of the kratom product to such a degree as to
render the kratom product injurious to a consumer.

new text begin Contaminated product. new text end

new text begin "Contaminated product" means a kratom product that
is contaminated with a dangerous nonkratom substance. A kratom product is contaminated
with a dangerous nonkratom substance if the kratom product contains a poisonous or
otherwise deleterious nonkratom ingredient, including but not limited to a controlled
substance listed under section 152.02.

new text begin Residual solvents. new text end

new text begin "Residual solvents" means a kratom extract that contains
levels of residual solvents higher than is allowed by United States Pharmacopeia 467.

new text begin Alkaloid fraction. new text end

new text begin "Alkaloid fraction" means a kratom product containing a
level of 7-hydroxymitragynine in the alkaloid fraction that is greater than two percent of
the overall alkaloid composition of the kratom product.

new text begin Synthetic alkaloids. new text end

new text begin "Synthetic alkaloids" means a kratom product containing
any synthetic alkaloids including synthetic mitragynine, synthetic 7-hydroxymitragynine,
or any other synthetically derived compound of kratom.

new text begin Inadequate labeling. new text end

new text begin "Inadequate labeling" means a kratom product that does
not provide adequate labeling direction necessary for safe and effective use by consumers,
including a recommended serving size.

Sec. 4.

new text begin [325F.998] VIOLATIONS.

new text begin Subdivision 1. new text end

new text begin Administrative penalty; appeal. new text end

new text begin A person who violates section 325F.997
is subject to an administrative penalty assessed by the commissioner under sections 34A.06
and 34A.07 and may contest the penalty as provided in section 34A.08.

new text begin Retailer limited exception. new text end

new text begin A kratom retailer is not in violation of section
325F.997 if it is shown by a preponderance of the evidence that the kratom retailer relied
in good faith upon the representations of a kratom processor, distributor, or wholesaler.
