A bill for an act
relating to children's health; prohibiting sale of children's food containers
containing bisphenol-A; proposing coding for new law in Minnesota Statutes,
chapter 325F.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) Beginning January 1, 2014, no manufacturer or
wholesaler may knowingly sell or offer for sale in this state a children's food container
that contains bisphenol-A.

(b) Beginning January 1, 2015, no retailer may knowingly sell or offer for sale in
this state a children's food container that contains bisphenol-A.

For purposes of this section, the following terms have the
meanings given.

(1) "Children's food" means a food or liquid that is commercially available and is
designed, intended, or marketed by a manufacturer to be consumed by a child 12 years
of age or younger.

(2) "Container" means a receptacle, box, can, or jar, including a lid, that is in direct
physical contact with a children's food.

This section is effective the day following final enactment.

A manufacturer shall not replace a chemical the use of which is prohibited in section
325F.174 with a chemical known to the manufacturer to have been designated by the
Department of Health as a chemical of high concern under section 116.9402.

This section is effective August 1, 2013, and applies to crimes
committed on or after that date.
