A bill for an act
relating to natural resources; modifying management plan requirements of certain
recreation area; appropriating money for recreational underpass; amending Laws
1999, chapter 231, section 99, subdivision 4.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Laws 1999, chapter 231, section 99, subdivision 4, is amended to read:


Subd. 4.

Management plan.

The commissioner of natural resources and the
local area advisory committee shall cooperatively develop a separate comprehensive
management plan for the land added to the Iron Range off-highway vehicle recreation area
under subdivision 1. The management plan shall provide for:

(1) multiple use recreation for off-highway vehicles;

(2) protection of natural resources;

(3) limited timber management;

(4) mineral exploration and mining management;

(5) land acquisition needs;

(6) road and facility development; deleted text begin anddeleted text end

(7) trail and road connections between the land added under subdivision 1 and the
land added by Laws 1996, chapter 407, section 32, subdivision 6new text begin ; and

new text begin (8) a trail, primarily for off-road vehicles, connecting lands in clause (7) and the city
of Eveleth, following the Mesabi Mountain proposed trail alignment to the extent possible
new text end .

The completed management plan, together with the management plan completed
under Laws 1996, chapter 407, section 32, subdivision 5, shall serve as the master plan
for the Iron Range off-highway vehicle recreation area under Minnesota Statutes, section
86A.09.

Sec. 2. new text begin APPROPRIATION.

new text begin $1,000,000 is appropriated in fiscal year 2009 from the natural resource fund to the
commissioner of natural resources for the development of the Virginia site and connecting
trails for the Iron Range Off-Highway Vehicle Recreation Area. Of this amount, $....... is
from the all-terrain vehicle account, $....... is from the off-highway motorcycle account,
and $....... is from the off-road vehicle account. This is a onetime appropriation. The
appropriation is available until expended for the design and development of an underpass
for off-highway vehicles on Highway 135 in the city of Gilbert. None of these funds may
be expended until all property within the Virginia site has been acquired.
