  1.1                          A bill for an act 
  1.2             relating to human services; requiring specialized 
  1.3             Alzheimer's disease training; providing for certain 
  1.4             grants; requiring the development of nursing assistant 
  1.5             training models; expanding Alzheimer's disease 
  1.6             training for family caregivers; appropriating money; 
  1.7             amending Minnesota Statutes 2002, sections 144A.04, by 
  1.8             adding a subdivision; 144A.38, by adding a 
  1.9             subdivision; 144A.45, by adding a subdivision; 
  1.10            144A.61, by adding a subdivision; 256B.0928; proposing 
  1.11            coding for new law in Minnesota Statutes, chapter 144D.
  1.12  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.13     Section 1.  Minnesota Statutes 2002, section 144A.04, is 
  1.14  amended by adding a subdivision to read: 
  1.15     Subd. 11.  [NURSING HOMES THAT SERVE PERSONS WITH 
  1.16  ALZHEIMER'S AND RELATED DISEASES.] (a) A nursing home that 
  1.17  provides services to residents with Alzheimer's and related 
  1.18  diseases must ensure that nursing home employees have 
  1.19  information, training, and guidance to understand and serve the 
  1.20  needs of persons with those diseases. 
  1.21     (b) Each nursing home referenced in paragraph (a) must 
  1.22  develop and implement policies to provide staff orientation, 
  1.23  training, and continuing education on Alzheimer's and related 
  1.24  diseases.  The nursing home may utilize various methods of 
  1.25  instruction, including, but not limited to, preceptorship, 
  1.26  mentoring, and other forms of observation and demonstration.  
  1.27  The instruction may be provided at a facility or off-site and 
  1.28  may include a combination of observational and practical 
  2.1   applications. 
  2.2      (c) An employee shall be issued a certificate upon 
  2.3   completion of training under paragraph (b), which includes the 
  2.4   name and signature of the training provider, the topics covered, 
  2.5   and the dates the training occurred.  The training is 
  2.6   transferable if the worker changes employment to another entity 
  2.7   that provides services to persons with Alzheimer's or related 
  2.8   diseases. 
  2.9      Sec. 2.  Minnesota Statutes 2002, section 144A.38, is 
  2.10  amended by adding a subdivision to read: 
  2.11     Subd. 4.  [GRANTS FOR ALZHEIMER'S DISEASE TREATMENT 
  2.12  TRAINING.] (a) Within the limits of appropriations specifically 
  2.13  for this purpose, grants may also be made to nursing homes, home 
  2.14  care agencies, and housing with services establishments that 
  2.15  serve persons with Alzheimer's or related diseases to: 
  2.16     (1) establish or expand training for staff that provide 
  2.17  services to these persons; and 
  2.18     (2) establish pilot projects that demonstrate the effect of 
  2.19  specialized dementia training for staff on staffing continuity 
  2.20  and quality of care.  Grants under this clause require a 50 
  2.21  percent nonstate match and approved projects must include an 
  2.22  evaluation component. 
  2.23     (b) In approving grants under this subdivision, the 
  2.24  commissioners shall consider the extent to which families and 
  2.25  employees have been allowed to assist in developing training 
  2.26  priorities. 
  2.27     Sec. 3.  Minnesota Statutes 2002, section 144A.45, is 
  2.28  amended by adding a subdivision to read: 
  2.29     Subd. 5.  [HOME CARE PROVIDERS THAT SERVE PERSONS WITH 
  2.30  ALZHEIMER'S AND RELATED DISEASES.] (a) A home care provider 
  2.31  licensed under section 144A.46 or 144A.4605 that provides 
  2.32  services to persons with Alzheimer's and related diseases must 
  2.33  ensure that employees have information, training, and guidance 
  2.34  to understand and serve the needs of persons with those diseases.
  2.35     (b) Each home care provider referenced in paragraph (a) 
  2.36  must develop and implement policies to provide staff 
  3.1   orientation, training, and continuing education on Alzheimer's 
  3.2   and related diseases.  The home care provider may utilize 
  3.3   various methods of instruction, including, but not limited to, 
  3.4   preceptorship, mentoring, and other forms of observation and 
  3.5   demonstration.  The instruction may be provided at a facility or 
  3.6   other location and may include a combination of observational 
  3.7   and practical applications. 
  3.8      (c) An employee shall be issued a certificate upon 
  3.9   completion of training under paragraph (b), which includes the 
  3.10  name and signature of the training provider, the topics covered, 
  3.11  and the dates the training occurred.  The training is 
  3.12  transferable if the worker changes employment to another entity 
  3.13  that provides services to persons with Alzheimer's or related 
  3.14  diseases. 
  3.15     Sec. 4.  Minnesota Statutes 2002, section 144A.61, is 
  3.16  amended by adding a subdivision to read: 
  3.17     Subd. 9.  [ADVANCED NURSING ASSISTANT TRAINING.] The 
  3.18  commissioner, in consultation with nursing assistants, home 
  3.19  health aides, trade associations, consumer advocates, unions, 
  3.20  and educators, shall develop and make available to relevant 
  3.21  educational institutions two 25-hour training models, one 
  3.22  covering dementia care and one covering complex medical needs.  
  3.23  The commissioner shall: 
  3.24     (1) encourage relevant educational institutions to make the 
  3.25  training available as a supplement to the federally mandated 
  3.26  75-hour nursing assistant training program; and 
  3.27     (2) encourage nursing homes and home care providers that 
  3.28  serve persons with Alzheimer's or related diseases to make the 
  3.29  training available to employees who provide services to these 
  3.30  persons. 
  3.31     Sec. 5.  [144D.065] [ESTABLISHMENTS THAT SERVE PERSONS WITH 
  3.32  ALZHEIMER'S AND RELATED DISEASES.] 
  3.33     (a) A housing with services establishment registered under 
  3.34  this chapter that provides services to persons with Alzheimer's 
  3.35  and related diseases must ensure that employees have 
  3.36  information, training, and guidance to understand and serve the 
  4.1   needs of persons with those diseases. 
  4.2      (b) Each establishment referenced in paragraph (a) must 
  4.3   develop and implement policies to provide staff orientation, 
  4.4   training, and continuing education on Alzheimer's and related 
  4.5   diseases.  The establishment may utilize various methods of 
  4.6   instruction, including, but not limited to, preceptorship, 
  4.7   mentoring, and other forms of observation and demonstration.  
  4.8   The instruction may be provided at a facility or other location 
  4.9   and may include a combination of observational and practical 
  4.10  applications. 
  4.11     (c) An employee shall be issued a certificate upon 
  4.12  completion of training under paragraph (b), which includes the 
  4.13  name and signature of the training provider, the topics covered, 
  4.14  and the dates the training occurred.  The training is

  4.17  diseases. 
  4.18     Sec. 6.  Minnesota Statutes 2002, section 256B.0928, is 
  4.19  amended to read: 
  4.20     256B.0928 [STATEWIDE CAREGIVER SUPPORT AND RESPITE CARE 
  4.21  PROJECT.] 
  4.22     The commissioner shall establish and maintain a statewide 
  4.23  caregiver support and respite care project.  The project shall: 
  4.24     (1) provide information, technical assistance, and training 
  4.25  statewide to county agencies and organizations on direct service 
  4.26  models of caregiver support and respite care services; 
  4.27     (2) identify and address issues, concerns, and gaps in the 
  4.28  statewide network for caregiver support and respite care; 
  4.29     (3) maintain a statewide caregiver support and respite care 
  4.30  resource center; 
  4.31     (4) educate caregivers on the availability and use of 
  4.32  caregiver and respite care services; 
  4.33     (5) promote and expand caregiver training and support 
  4.34  groups using existing networks when possible; and 
  4.35     (6) apply for and manage grants related to caregiver 
  4.36  support and respite care; and 
  5.1      (7) promote and expand dementia training for family 
  5.2   caregivers. 
  5.3      Sec. 7.  [APPROPRIATIONS.] 
  5.4      (a) $....... is appropriated from the general fund to the 
  5.5   commissioners of human services and of health for the biennium 
  5.6   beginning July 1, 2003, for the purposes of section 2. 
  5.7      (b) $....... is appropriated from the general fund to the 
  5.8   commissioner of health for the biennium beginning July 1, 2003, 
  5.9   for the purposes of section 4. 
  5.10     (c) $....... is appropriated from the general fund to the 
  5.11  commissioner of human services for the biennium beginning July 
  5.12  1, 2003, for the purposes of section 6.
