A bill for an act
relating to real property; providing for the removal of racial covenants in recorded
documents; amending Minnesota Statutes 2020, section 507.18, by adding a
subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 507.18, is amended by adding a subdivision
to read:

new text begin Permanent removal of racial covenants. new text end

new text begin Every county recorder and registrar
of titles shall permanently redact all racial covenants contained in all documents previously
accepted for recording upon court order. The Office of the Attorney General shall petition
each court with competent jurisdiction for an order directing permanent redaction of all
racial covenants contained in recorded documents. Upon an order directing permanent
redaction of a racial covenant, the county recorder or registrar of titles shall archive the
original unredacted recorded document with the Minnesota Historical Society for educational
purposes.
