A bill for an act
relating to human services; allowing for costs associated with physical activities
to be covered under home and community-based waivers; amending Minnesota
Statutes 2006, section 256B.092, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 256B.092, is amended by adding a
subdivision to read:

new text begin Effective upon federal
approval, the costs associated with physical exercise or other physical activities to
maintain or improve a person's health and functioning shall be an allowed expense for
home and community-based waiver programs for persons with disabilities. By October 1,
2008, the commissioner of human services shall submit an amendment to the Centers for
Medicare and Medicaid Services consistent with this subdivision.
