A bill for an act
relating to transportation; increasing fines for certain traffic violations around
school buses; requiring violator to attend driver improvement clinic; amending
Minnesota Statutes 2016, section 169.444, subdivision 2.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2016, section 169.444, subdivision 2, is amended to read:
(a) A person who fails to stop a vehicle or
to keep it stopped, as required in subdivision 1, or who violates subdivision 1a, is guilty of
a misdemeanor punishable bynew text begin : (1)new text end a fine of not less than deleted text begin $300deleted text end new text begin $500; and (2) a requirement
that the person attend and successfully complete a course of study at an approved driver
improvement clinic or youth-oriented driver improvement clinicnew text end .
(b) A person is guilty of a gross misdemeanor if the person fails to stop a motor vehicle
or to keep it stopped, as required in subdivision 1, or who violates subdivision 1a, and
commits either or both of the following acts:
(1) passes or attempts to pass the school bus in a motor vehicle on the right-hand,
passenger-door side of the bus; or
(2) passes or attempts to pass the school bus in a motor vehicle when a school child is
outside of and on the street or highway used by the school bus or on the adjacent sidewalk.

(c) An agency, court, or public official in Minnesota is prohibited from masking, deferring
imposition of judgment for, or allowing an individual to enter into a diversion program that
would prevent a conviction for violating this subdivision from appearing on the driving
record of a driver's license holder.

The amendment to paragraph (a), clause (1), is effective August
1, 2017, and applies to violations committed on and after that date. The amendment to
paragraph (a), clause (2), is effective August 1, 2018, and applies to violations committed
on and after that date. Paragraph (c) is effective the day following final enactment.
