  1.1                          A bill for an act 
  1.2             relating to crime prevention; appropriating funds from 
  1.3             the automobile theft prevention special revenue 
  1.4             account for automobile theft prevention activities; 
  1.5             removing certain types of vehicles from the surcharge 
  1.6             for auto theft prevention; amending Minnesota Statutes 
  1.7             1998, section 168A.40, subdivision 3. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1998, section 168A.40, 
  1.10  subdivision 3, is amended to read: 
  1.11     Subd. 3.  [SURCHARGE.] Each insurer engaged in the writing 
  1.12  of policies of automobile insurance shall collect a surcharge, 
  1.13  at the rate of 50 cents per vehicle for every six months of 
  1.14  coverage, on each policy of automobile insurance providing 
  1.15  comprehensive insurance coverage issued or renewed in this 
  1.16  state.  The surcharge may not be considered premium for any 
  1.17  purpose, including the computation of premium tax or agents' 
  1.18  commissions.  The amount of the surcharge must be separately 
  1.19  stated on either a billing or policy declaration sent to an 
  1.20  insured.  Insurers shall remit the revenue derived from this 
  1.21  surcharge at least quarterly to the board for purposes of the 
  1.22  automobile theft prevention program.  For purposes of this 
  1.23  subdivision, "policy of automobile insurance" has the meaning 
  1.24  given it in section 65B.14, means a policy of insurance covering 
  1.25  the following types of vehicles as defined in section 168.11: 
  1.26     (1) a passenger automobile; 
  2.1      (2) a pick-up truck; 
  2.2      (3) a van; or 
  2.3      (4) a motorcycle, 
  2.4   except that no vehicle with a gross vehicle weight in excess of 
  2.5   10,000 pounds is included within this definition. 
  2.6      Sec. 2.  [APPROPRIATION.] 
  2.7      $....... is appropriated from the automobile theft 
  2.8   prevention special revenue account to the automobile theft 
  2.9   prevention board for automobile theft prevention activities 
  2.10  under Minnesota Statutes, section 168A.40.  This appropriation 
  2.11  is available until expended.
