  1.1                          A bill for an act
  1.2             relating to legal newspapers; providing for the effect 
  1.3             of certain errors in publication; authorizing the city 
  1.4             of Roseville and independent school district No. 623 
  1.5             to consider cost as a criterion in the designation of 
  1.6             newspapers for official publication; amending 
  1.7             Minnesota Statutes 1996, section 331A.05, by adding a 
  1.8             subdivision. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1996, section 331A.05, is 
  1.11  amended by adding a subdivision to read: 
  1.12     Subd. 7.  [ERRORS IN PUBLICATION.] If through no fault of 
  1.13  the local public corporation, an error occurs in the publication 
  1.14  of a public notice, the error shall have no effect on the 
  1.15  validity of the event, action, or proceeding to which the public 
  1.16  notice relates. 
  1.17     Sec. 2.  [ROSEVILLE, INDEPENDENT SCHOOL DISTRICT NO. 623.] 
  1.18     If the cost of publishing public notices would be lower in 
  1.19  a qualified newspaper other than one designated in accordance 
  1.20  with Minnesota Statutes, section 331A.04, subdivisions 2 to 5, 
  1.21  the city of Roseville or independent school district No. 623 may 
  1.22  designate another qualified newspaper, if for one year prior to 
  1.23  designation, at least 25 percent of that newspaper's circulation 
  1.24  has been within the Roseville city limits or within the 
  1.25  boundaries of independent school district No. 623, 
  1.26  respectively.  The city of Roseville and independent school 
  1.27  district No. 623 may:  (a) solicit bids, or (b) designate the 
  2.1   newspaper offering to publish the notices at the lowest cost.  
  2.2   The governing body of the city of Roseville or independent 
  2.3   school district No. 623 may rely on the sworn statement of the 
  2.4   publisher of the newspaper, or the publisher's designated 
  2.5   representative, regarding the newspaper's circulation within the 
  2.6   city of Roseville or the boundaries of independent school 
  2.7   district No. 623. 
  2.8      Sec. 3.  [EFFECTIVE DATE.] 
  2.9      Section 2 is effective as to the city of Roseville or 
  2.10  independent school district No. 623 upon its approval by the 
  2.11  respective governing bodies and upon compliance with Minnesota 
  2.12  Statutes, section 645.021, subdivision 3.
