  1.1                          A bill for an act 
  1.2             relating to retirement; public employees police and 
  1.3             fire retirement plan; city of Anoka; authorizing 
  1.4             retirement coverage for certain fire marshals who 
  1.5             formerly were firefighters. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [CITY OF ANOKA; PERA-P&F COVERAGE FOR FIRE 
  1.8   MARSHAL.] 
  1.9      (a) This section applies to a person who: 
  1.10     (1) was born on November 12, 1940; 
  1.11     (2) was employed by the city of Anoka as a firefighter on 
  1.12  June 6, 1968, and as fire chief on July 24, 1978; 
  1.13     (3) subsequently was employed by the city of Anoka as a 
  1.14  fire marshal on November 1, 1979; 
  1.15     (4) is a member of the coordinated program of the public 
  1.16  employees retirement association; and 
  1.17     (5) is currently employed as a fire marshal by the city of 
  1.18  Anoka. 
  1.19     (b) An eligible person described in paragraph (a) is a 
  1.20  member of the public employees police and fire plan from the 
  1.21  first day of the month next following the effective date of this 
  1.22  section.  
  1.23     Sec. 2.  [EFFECTIVE DATE.] 
  1.24     Section 1 is effective on the day following the later of 
  1.25  the: 
  2.1      (1) receipt of an affirmative written determination from 
  2.2   the secretary of the federal Department of Health and Human 
  2.3   services of the eligibility of the eligible person described in 
  2.4   section 1 for an exclusion from coverage under the federal old 
  2.5   age, survivors, and disability insurance program; and 
  2.6      (2) date on which the governing body of the city of Anoka 
  2.7   and its chief clerical officer complete in a timely fashion 
  2.8   their compliance with Minnesota Statutes, section 645.021, 
  2.9   subdivisions 2 and 3.
