1.1 A bill for an act 1.2 relating to the St. Paul port authority; changing the 1.3 powers and jurisdiction with respect to recreation 1.4 facilities and recreation purposes; amending Minnesota 1.5 Statutes 1998, section 469.084, subdivisions 1 and 4. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 1998, section 469.084, 1.8 subdivision 1, is amended to read: 1.9 Subdivision 1. [POWERS RELATED TO RECREATIONAL 1.10 FACILITIES.] Notwithstanding any law to the contrary, the port 1.11 authority of the city of St. Paul may plan for, acquire by 1.12 condemnation, purchase, or otherwise, construct, improve, 1.13 operate, directly, by lease or otherwise, and maintain parks and 1.14 other recreation facilitiesalong navigable rivers and lakes1.15 anywhere within its port district, and on lands abutting the1.16rivers and lakes. The port authority shall establish rules on 1.17 the use of the rivers, lakes, parks and recreation facilities 1.18 either alone or in cooperation with the federal government or 1.19 its agencies, the city of St. Paul, the state, or an agency or 1.20 political subdivision of the state. 1.21 Sec. 2. Minnesota Statutes 1998, section 469.084, 1.22 subdivision 4, is amended to read: 1.23 Subd. 4. [PORT JURISDICTION.] For all other recreation 1.24 purposes the port authority has jurisdiction over the use of all 1.25 the navigable rivers or lakes and all the parks and recreation 2.1 facilities abutting the rivers and lakes.
