A bill for an act
relating to health care; prohibiting the use of discounts or free product vouchers
for certain prescription drugs; proposing coding for new law in Minnesota Statutes,
chapter 151.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) A drug manufacturer, wholesale drug distributor, or any agent of a drug manufacturer
or wholesale drug distributor is prohibited from offering or providing any discount, rebate,
product voucher, or other reduction to an individual's out-of-pocket expenses, including
co-payments and deductibles for any prescription drug that has an AB-rated generic
equivalent as determined by the United States Food and Drug Administration. This
prohibition includes discounts, rebates, product vouchers, or other reductions that are
provided directly or electronically to a prescriber or to an individual or through a mail-in
rebate, or other similar means. This prohibition does not include discounts, rebates, product
vouchers, or other reductions that are provided by a pharmacist or pharmacy to an individual
at point of sale.

(b) Nothing in this section restricts how a manufacturer distributes a prescription drug
or affects the obligations of a prescriber or pharmacist under section 151.21.
