  1.1                          A bill for an act 
  1.2             relating to civil actions; limiting liability of 
  1.3             financial institutions providing data for the criminal 
  1.4             alert network; amending Minnesota Statutes 1996, 
  1.5             section 299A.61, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 299A.61, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 3.  [LIMIT ON LIABILITY OF FINANCIAL INSTITUTIONS.] A 
  1.10  financial institution that provides data to the criminal alert 
  1.11  network on the use of fraudulent checks is not liable for a 
  1.12  mistake in providing data, if the financial institution 
  1.13  establishes that the mistake was not intentional and resulted 
  1.14  from a bona fide error, notwithstanding the maintenance of 
  1.15  procedures reasonably adapted to avoid error.
