  1.1                          A bill for an act
  1.2             relating to crime; requiring separation of mentally 
  1.3             ill inmates from other inmates; proposing coding for 
  1.4             new law in Minnesota Statutes, chapters 243; and 641.  
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [243.551] [MENTALLY ILL INMATES.] 
  1.7      (a) The commissioner of corrections is responsible for: 
  1.8      (1) identifying mentally ill inmates; and 
  1.9      (2) ensuring that mentally ill inmates are physically 
  1.10  separated by sight and sound from other inmates. 
  1.11     (b) The separation of mentally ill inmates from other 
  1.12  inmates must not interfere with mentally ill inmates' access to 
  1.13  vocational and educational activities. 
  1.14     (c) Nothing in this section shall interfere with the 
  1.15  transfer of a mentally ill inmate under section 253.21, or civil 
  1.16  commitment of an inmate under chapter 253B, when a transfer or 
  1.17  commitment is necessary. 
  1.18     (d) "Mentally ill" has the meaning given "mental illness" 
  1.19  in section 245.462, subdivision 20, paragraph (a). 
  1.20     Sec. 2.  [641.145] [MENTALLY ILL PRISONERS.] 
  1.21     (a) The sheriff of each county is responsible for: 
  1.22     (1) identifying mentally ill prisoners; and 
  1.23     (2) ensuring that mentally ill prisoners are physically 
  1.24  separated by sight and sound from other prisoners. 
  1.25     (b) The separation of mentally ill prisoners from other 
  2.1   prisoners must not interfere with mentally ill prisoners' access 
  2.2   to vocational and educational activities. 
  2.3      (c) Nothing in this section shall interfere with the 
  2.4   transfer of a mentally ill prisoner under section 253.21, or 
  2.5   civil commitment of a prisoner under chapter 253B, when a 
  2.6   transfer or commitment is necessary. 
  2.7      (d) "Mentally ill" has the meaning given "mental illness" 
  2.8   in section 245.462, subdivision 20, paragraph (a). 
  2.9      Sec. 3.  [EFFECTIVE DATE.] 
  2.10     Sections 1 and 2 are effective August 1, 1998.
