A bill for an act
relating to commerce; regulating the sale of certain products containing triclosan;
establishing labeling requirements; proposing coding for new law in Minnesota
Statutes, chapter 325F.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Except as otherwise provided in subdivision 2,
no person shall sell or offer for sale to consumers in Minnesota on either the wholesale
or retail level, any personal care products, cosmetics, or cleaning products containing
triclosan unless the notice required by subdivision 3 is included in its labeling in a
conspicuous manner.

Subdivision 1 does not apply to a product containing triclosan
that has been approved by the United States Food and Drug Administration for consumer
use.

Any product subject to subdivision 1 must include
the following notice in its labeling:

"This product contains Triclosan, which is under investigation by the United States
Food and Drug Administration."
