  1.1                          A bill for an act 
  1.2             relating to the metropolitan area; requiring the 
  1.3             metropolitan council to perform, in the metropolitan 
  1.4             area, all duties mandated by state law on counties; 
  1.5             proposing coding for new law in Minnesota Statutes, 
  1.6             chapter 473. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [473.1415] [METROPOLITAN COUNCIL; PERFORMANCE 
  1.9   OF DUTIES MANDATED BY STATE LAW ON COUNTIES.] 
  1.10     Subdivision 1.  [PURPOSE.] To provide public services in 
  1.11  the metropolitan area more efficiently and effectively, it is 
  1.12  desirable to centralize in the metropolitan council those 
  1.13  programs and procedures that are mandated by law for performance 
  1.14  by counties.  
  1.15     Subd. 2.  [DUTIES TRANSFERRED TO METRO COUNCIL.] Within the 
  1.16  metropolitan area, as defined in section 473.121, subdivision 2, 
  1.17  the metropolitan council shall perform all of the duties 
  1.18  mandated by state law to be performed by counties.  These 
  1.19  duties, and all powers of counties necessary to perform these 
  1.20  duties, are transferred to the metropolitan council.  The duties 
  1.21  mandated on counties by state law include programs and 
  1.22  procedures such as the following, under the laws cited and 
  1.23  related laws:  
  1.24     Attorney duties, chapter 388 
  1.25     Auditor duties, chapter 384 
  1.26     Child care programs, sections 256H.01 to 256H.20 
  2.1      Coroner duties, chapter 390 
  2.2      County extension work, section 38.36 
  2.3      Courthouse, section 373.05 
  2.4      Elections, chapter 204B 
  2.5      Health, section 145A.03 
  2.6      Highways and roads, chapter 163 
  2.7      Medical assistance for needy persons, section 256B.05 
  2.8      Mental retardation, case management, section 256B.092 
  2.9      Prisoners; feeding, medical care, section 641.15 
  2.10     Public assistance, sections 256.72 to 256.871 
  2.11     Public defender, section 611.27 
  2.12     Recorder duties, chapter 386 
  2.13     Sheriff duties, chapter 387 
  2.14     Treasurer duties, chapter 385 
  2.15     Weed control, sections 18.80 and 18.81. 
  2.16     Sec. 2.  [STUDY.] 
  2.17     The metropolitan council shall review and study the duties 
  2.18  and powers of counties in the metropolitan area for the purpose 
  2.19  of determining those duties mandated by state law that should be 
  2.20  included in or excluded from, section 1, and any changes in law 
  2.21  that are necessary or desirable to most effectively accomplish 
  2.22  the purposes of section 1.  The metropolitan council shall 
  2.23  submit a report on its study to the legislature before January 
  2.24  1, 1997, detailing its conclusions and recommendations. 
  2.25     Sec. 3.  [APPLICATION.] 
  2.26     Sections 1 and 2 apply in the counties of Anoka, Carver, 
  2.27  Dakota, Hennepin, Ramsey, Scott, and Washington.  
  2.28     Sec. 4.  [EFFECTIVE DATE.] 
  2.29     Section 1 is effective on January 1, 1998.  Sections 2 and 
  2.30  3 are effective the day after final enactment.
