  1.1                          A bill for an act 
  1.2             relating to human services; increasing the income 
  1.3             eligibility standard for medical assistance for the 
  1.4             aged, blind, or disabled; amending Minnesota Statutes 
  1.5             1997 Supplement, section 256B.056, subdivision 4. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1997 Supplement, section 
  1.8   256B.056, subdivision 4, is amended to read: 
  1.9      Subd. 4.  [INCOME.] To be eligible for medical assistance, 
  1.10  a person must not have, or anticipate receiving, semiannual 
  1.11  income in excess of 120 percent of the income standards by 
  1.12  family size used under the aid to families with dependent 
  1.13  children state plan as of July 16, 1996, as required by the 
  1.14  Personal Responsibility and Work Opportunity Reconciliation Act 
  1.15  of 1996 (PRWORA), Public Law Number 104-193, except 
  1.16  that eligible under section 256B.055, subdivision 7, and 
  1.17  families and children may have an income up to 133-1/3 percent 
  1.18  of the AFDC income standard.  In computing income to determine 
  1.19  eligibility of persons who are not residents of long-term care 
  1.20  facilities, the commissioner shall disregard increases in income 
  1.21  as required by Public Law Numbers 94-566, section 503; 99-272; 
  1.22  and 99-509.  Veterans aid and attendance benefits and Veterans 
  1.23  Administration unusual medical expense payments are considered 
  1.24  income to the recipient.
