A bill for an act
relating to land; requiring transfer of federal lands to the state; proposing coding
for new law in Minnesota Statutes, chapter 94.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Subdivision 1. new text end

new text begin Definition. new text end

new text begin For the purposes of this section, "federal lands" includes
lands the United States holds title to within the state and does not include:

new text begin (1) land belonging to an American Indian tribe held in trust by the United States; and
new text end

new text begin (2) land designated as a national park, national monument, national wilderness, or
national historic site on or before January 1, 2012.

new text begin Subd. 2. new text end

new text begin Transfer of lands. new text end

new text begin On or before December 31, 2014, the United States
shall:
new text end

new text begin (1) extinguish title to federal lands within the state; and
new text end

new text begin (2) transfer title of the federal lands to the state.

new text begin Subd. 3. new text end

new text begin Disposition of proceeds from transferred lands. new text end

new text begin If the state transfers
title to lands transferred to the state under subdivision 2, the state shall retain five percent
of the proceeds from the transfer. The remainder of the proceeds shall be transferred to
the United States.

new text begin Commissioner's duties. new text end

new text begin (a) By January 15, 2013, the commissioner
of natural resources shall:
new text end

new text begin (1) coordinate the transfer of title of federal lands to the state;
new text end

new text begin (2) create a plan for the management of the federal lands transferred to the state
under this section; and
new text end

new text begin (3) prepare draft legislation necessary to facilitate the transfer and management
of federal lands under this section and submit the draft legislation to the chairs of the
house of representatives and senate committees with jurisdiction over the environment
and natural resources.

new text begin (b) If the United States fails to transfer lands as required under subdivision 2, the
commissioner shall establish actions that shall be taken to secure, preserve, and protect
the state's rights and benefits provided under this section.

new text begin If any provision of this section is held invalid, illegal, or
unenforceable for any reason and in any respect, the holding does not affect the validity
of the remainder of the section.
