A bill for an act
relating to agriculture; authorizing certain food additives derived from industrial
hemp; requiring rulemaking; amending Minnesota Statutes 2020, section 31.01,
by adding subdivisions; proposing coding for new law in Minnesota Statutes,
chapter 31.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 31.01, is amended by adding a subdivision
to read:

new text begin "Industrial hemp" has the meaning given in section 18K.02,
subdivision 3.

Sec. 2.

Minnesota Statutes 2020, section 31.01, is amended by adding a subdivision to
read:

new text begin Industrial hemp extract. new text end

new text begin "Industrial hemp extract" means a food additive
consisting of one or more nonintoxicating cannabinoids of industrial hemp.

Sec. 3.

new text begin [31.98] INDUSTRIAL HEMP EXTRACT; RULEMAKING.

new text begin Approved additive. new text end

new text begin Notwithstanding section 31.101, subdivision 4,
industrial hemp extract is an approved food additive for intrastate commerce, subject to
state and local law.

new text begin The commissioner must adopt rules concerning:

new text begin (1) the production and manufacture of industrial hemp extract and food containing
industrial hemp extract;

new text begin (2) the tolerance level required for food additives under section 31.122;
new text end

new text begin (3) labeling requirements for industrial hemp extract and food containing industrial hemp
extract; and
new text end

new text begin (4) batch testing requirements for industrial hemp extract, which may include criteria
and procedures for certifying laboratories that perform batch testing.
