A bill for an act
relating to taxation; local government aid; disaster aid to city of St. Charles;
amending Laws 2009, chapter 93, article 4, section 1.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Laws 2009, chapter 93, article 4, section 1, is amended to read:

new text begin (a) new text end For fiscal years 2010 and 2011 only, Independent School District No. 858, St.
Charles, is eligible for declining pupil unit aid equal to the lesser of $242,000 or the
product of $5,124 and the number of adjusted pupil units lost during that year as a result
of the April 2009 fire. Notwithstanding Minnesota Statutes, section 126C.13, the amounts
required under this section are included in the general education aid payments for the
district. The district must provide the commissioner of education documentation of the
students lost as a result of the fire.new text begin

new text begin (b) If the amount of declining pupil unit aid paid to Independent School District No.
858, St. Charles, under paragraph (a) is less than $242,000 per year for fiscal years 2010
and 2011, then the difference between the amount paid per year for fiscal years 2010 and
2011 and $242,000 is appropriated from the general fund to the commissioner of revenue
for aid to the city of St. Charles. The aid shall be paid as prescribed in Minnesota Statutes,
section 477A.015. This aid is to help the city cover revenue losses due to the April 2009
fire that closed down the city's largest employer.
