A bill for an act
relating to liquor; establishing license to authorize winemaking supply store to sell
homemade wine on its premises; amending Minnesota Statutes 2016, section
340A.101, by adding a subdivision; proposing coding for new law in Minnesota
Statutes, chapter 340A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2016, section 340A.101, is amended by adding a subdivision
to read:

new text begin A "winemaking supply store" is a store whose
primary business is selling portable equipment designed for use in home manufacturing of
wine, and supplies and ingredients for home manufacturing of wine.

Sec. 2.

new text begin [340A.3155] WINEMAKING SUPPLY STORE LICENSE.

new text begin The commissioner may issue a winemaking supply store license
to a winemaking supply store. Licenses may be issued and renewed for an annual fee of
$25, which is in lieu of all other license fees required by this chapter.

new text begin Off-sale of wine. new text end

new text begin (a) A license issued under subdivision 1 authorizes a
winemaking supply store to sell at off-sale up to 5,000 gallons of wine from its premises
each year. The wine must be produced by the licensee on the licensed premises using
equipment that is available for sale on the premises, or equipment that is substantially similar
to equipment that is available for sale on the premises. Off-sale of wine under this subdivision
must be limited to the legal hours for off-sale at exclusive liquor stores in the jurisdiction
in which the winemaking supply store is located and the wine sold must be removed from
the premises before the applicable off-sale closing time at exclusive liquor stores. Labels
for each type or brand produced must be registered with the commissioner without fee prior
to sale.

new text begin (b) A license issued under this subdivision also authorizes a winemaking supply store
to provide on the licensed premises free samples of wine that are available for sale. Samples
must only be provided during the permitted hours of sale in a quantity less than 50 milliliters
per variety per customer.

new text begin A municipality must not issue an on-sale license
for a premises that is licensed under this section.

new text begin Except as otherwise specified in this section, all provisions of
this chapter govern the production, sale, possession, and consumption of wine produced by
a winemaking supply store.

new text begin Nothing in this section prevents the holder
of a license under this section from operating a winemaking on premises store as described
in section 340A.34 on the same premises as the winemaking supply store.
