  1.1                          A bill for an act 
  1.2             relating to recreational vehicles; requiring 
  1.3             snowmobiles registered in another jurisdiction to have 
  1.4             a state trail use sticker; amending Minnesota Statutes 
  1.5             1997 Supplement, section 84.8205.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1997 Supplement, section 
  1.8   84.8205, is amended to read: 
  1.9      84.8205 [SNOWMOBILE STATE TRAIL PERMIT STICKER.] 
  1.10     Subdivision 1.  [STICKER.] A snowmobile that is not 
  1.11  registered in this state may not be operated on a state or 
  1.12  grant-in-aid snowmobile trail unless the snowmobile operator has 
  1.13  in possession displays a snowmobile state trail permit sticker.  
  1.14  The commissioner of natural resources shall issue a permit 
  1.15  sticker upon application and payment of a $15 fee.  The permit 
  1.16  sticker is valid from November 1 through April 30.  Fees 
  1.17  collected under this section shall be deposited in the state 
  1.18  treasury and credited to the snowmobile trails and enforcement 
  1.19  account in the natural resources fund. 
  1.20     Subd. 2.  [PLACEMENT.] The trail sticker shall be 
  1.21  permanently affixed to the forward half of the snowmobile 
  1.22  directly above or below the headlight of the snowmobile. 
  1.23     Subd. 3.  [LICENSE AGENTS.] (a) County auditors are 
  1.24  appointed agents of the commissioner for the sale of snowmobile 
  1.25  state trail stickers.  The commissioner may appoint other state 
  2.1   agencies as agents for the sale of the stickers.  A county 
  2.2   auditor may appoint subagents within the county or within 
  2.3   adjacent counties to sell stickers.  Upon appointment, the 
  2.4   auditor shall notify the commissioner of the name and address of 
  2.5   the subagent.  The auditor may revoke the appointment of a 
  2.6   subagent and the commissioner may revoke the appointment of a 
  2.7   state agency at any time.  Upon demand of the commissioner, the 
  2.8   auditor shall revoke a subagent's appointment.  The auditor 
  2.9   shall furnish stickers on consignment to any subagent who 
  2.10  furnishes a surety bond in favor of the county in an amount at 
  2.11  least equal to the value of the stickers to be consigned to that 
  2.12  subagent.  A surety bond is not required of a state agency 
  2.13  appointed by the commissioner.  The county auditor shall be 
  2.14  responsible for all stickers issued to and user fees received by 
  2.15  agents, except in a county where the county auditor does not 
  2.16  retain fees paid for license purposes.  In these counties, the 
  2.17  responsibilities imposed on the county auditor are imposed on 
  2.18  the county.  The commissioner may adopt additional rules as 
  2.19  provided in section 97A.485, subdivision 11. 
  2.20     (b) Any resident desiring to sell snowmobile state trail 
  2.21  stickers may either purchase for cash or obtain on consignment 
  2.22  stickers from a county auditor in groups of not less than ten 
  2.23  individual stickers.  In selling stickers, the resident shall be 
  2.24  deemed a subagent of the county auditor and the commissioner, 
  2.25  and shall observe all rules adopted by the commissioner for 
  2.26  accounting and handling of licenses according to section 
  2.27  97A.485, subdivision 11. 
  2.28     (c) The county auditor shall promptly deposit all money 
  2.29  received from the sale of the stickers with the county 
  2.30  treasurer, and shall promptly transmit any reports required by 
  2.31  the commissioner, plus 96 percent of the price to each sticker 
  2.32  holder, exclusive of the issuing fee, for each sticker sold or 
  2.33  consigned by the auditor and subsequently sold to a sticker 
  2.34  holder during the accounting period.  The county auditor shall 
  2.35  retain as a commission four percent of all sticker fees, 
  2.36  excluding the issuing fee for stickers consigned to subagents 
  3.1   and the issuing fee on stickers sold by the auditor to sticker 
  3.2   holders. 
  3.3      (d) Unsold stickers in the hands of any subagent shall be 
  3.4   redeemed by the commissioner if presented for redemption within 
  3.5   the time prescribed by the commissioner.  Any stickers not 
  3.6   presented for redemption within the period prescribed shall be 
  3.7   conclusively presumed to have been sold, and the subagent 
  3.8   possessing the stickers or to whom they are charged shall be 
  3.9   accountable. 
  3.10     Subd. 4.  [FORM.] The department shall provide stickers to 
  3.11  all agents authorized to issue stickers by the commissioner. 
  3.12     Subd. 5.  [AGENT'S FEE.] The fee for a sticker shall be 
  3.13  increased by the amount of an issuing fee of $1 per sticker.  
  3.14  The issuing fee may be retained by the seller of the sticker.
