1.3relating to natural resources; expanding prohibitions on the appropriation of
1.4water from the Mt. Simon-Hinckley aquifer;amending Minnesota Statutes 2008,
1.5section 103G.271, subdivision 4a.

1.11We, the undersigned conferees for H. F. No. 2634 report that we have agreed upon
1.12the items in dispute and recommend as follows:
1.13That the Senate recede from its amendment and that H. F. No. 2634 be further
1.14amended as follows:
1.15Delete everything after the enacting clause and insert:

1.16    "Section 1. Minnesota Statutes 2008, section 103G.271, subdivision 4a, is amended to
1.17read:
1.18    Subd. 4a. Mt. Simon-Hinckley aquifer. (a) Except as provided in paragraph
1.19(b), the commissioner may not issue new water use permits that will appropriate water
1.20from for the Mt. Simon-Hinckley aquifer in a metropolitan county, as defined in section
1.21473.121, subdivision 4, unless the appropriation is for potable domestic water use, there
1.22are no feasible or practical alternatives to this source, and a water conservation plan
1.23is incorporated with the permit. Domestic water uses include water used for general
1.24household purposes for essential human needs such as cooking, cleaning, drinking,
1.25washing, and waste disposal.
1.26(b) The commissioner shall terminate all permits authorizing appropriation and
1.27use of water from the Mt. Simon-Hinckley aquifer for once-through systems in a
1.28metropolitan county, as defined in section 473.121, subdivision 4, by December 31, 1992.
1.29Notwithstanding paragraph (a), the commissioner may issue a new water use permit for
2.1the Mt. Simon-Hinckley aquifer for nondomestic use if there are no feasible or practical
2.2alternatives to the use of the aquifer, and water recycling and water conservation plans,
2.3as determined by the commissioner, are required under the permit. The commissioner
2.4shall ensure that a holder of a permit issued under this paragraph is implementing all
2.5water recycling and conservation plans required under the permit. This paragraph does
2.6not apply within a metropolitan county, as defined in section 473.121, subdivision 4,
2.7or Chisago County."
