  1.1                          A bill for an act 
  1.2             relating to elections; city elections; providing for 
  1.3             the election of certain council members elected by 
  1.4             ward after reapportionment; amending Minnesota 
  1.5             Statutes 2000, section 205.84, subdivisions 1 and 2. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 205.84, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [GENERAL PROVISIONS.] (a) In a city 
  1.10  electing council members by wards, wards shall be as equal in 
  1.11  population as practicable and each ward shall be composed of 
  1.12  compact, contiguous territory.  Each council member shall be a 
  1.13  resident of the ward for which elected, but a change in ward 
  1.14  boundaries does not disqualify a council member from serving for 
  1.15  the remainder of a term.  
  1.16     (b) In a city where council members are elected by ward to 
  1.17  serve for four years to terms that are not staggered, if the 
  1.18  population of any ward changes by five percent or more, all 
  1.19  council members must be elected to new terms at the first 
  1.20  municipal general election after ward boundaries are redefined 
  1.21  under subdivision 2; provided, however, that if no municipal 
  1.22  general election would otherwise occur in the year ending in 
  1.23  "3," a municipal general election must be held in the year 
  1.24  ending in "3." 
  1.25     Sec. 2.  Minnesota Statutes 2000, section 205.84, 
  2.1   subdivision 2, is amended to read: 
  2.2      Subd. 2.  [EFFECTIVE DATE.] After the official 
  2.3   certification of the federal decennial or special census, the 
  2.4   governing body of the city shall either confirm the existing 
  2.5   ward boundaries as conforming to the standards of subdivision 1 
  2.6   or redefine ward boundaries to conform to those standards as 
  2.7   provided in section 204B.135, subdivision 1.  If the governing 
  2.8   body of the city fails to take either action within the time 
  2.9   required, no further compensation shall be paid to the mayor or 
  2.10  council member until the wards of the city are either 
  2.11  reconfirmed or redefined as required by this section.  An 
  2.12  ordinance establishing new ward boundaries pursuant to section 
  2.13  204B.135, subdivision 1, becomes effective on the date of the 
  2.14  state primary that filings open for the state general election 
  2.15  in the year ending in two.  
  2.16     Sec. 3.  [EFFECTIVE DATE.] 
  2.17     Sections 1 and 2 are effective the day following final 
  2.18  enactment.
