  1.1                          A bill for an act 
  1.2             relating to game and fish; providing for bonding of 
  1.3             license subagents; amending Minnesota Statutes 1996, 
  1.4             section 97A.485, subdivision 3. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1996, section 97A.485, 
  1.7   subdivision 3, is amended to read: 
  1.8      Subd. 3.  [APPOINTMENT AND BONDING OF SUBAGENTS.] (a) A 
  1.9   county auditor may appoint residents to be subagents of the 
  1.10  auditor within the county or adjacent counties to issue and sell 
  1.11  licenses.  The auditor shall notify the commissioner of the name 
  1.12  and address of a subagent when appointed.  The appointment may 
  1.13  be revoked by the auditor at any time, and when directed by the 
  1.14  commissioner, the auditor must revoke the appointment.  
  1.15     (b) A county auditor may require a subagent who wishes to 
  1.16  sell licenses on consignment to provide a surety bond according 
  1.17  to this paragraph.  A subagent who has provided a surety bond to 
  1.18  the county auditor in a previous year is not required to furnish 
  1.19  a surety bond if the subagent is not issued, at any one time, 
  1.20  licenses with a value of more than $50,000.  A subagent who has 
  1.21  provided a surety bond to the county auditor in a previous year 
  1.22  and who is issued, at any one time, licenses with a value of 
  1.23  more than $50,000 shall be bonded in an amount equal to the 
  1.24  total value of the licenses issued to the subagent, less 
  1.25  $50,000.  A subagent who has not provided a surety bond to the 
  2.1   county auditor in a previous year or who has forfeited a surety 
  2.2   bond in a previous year shall be bonded in an amount equal to 
  2.3   the total value of the licenses issued to the subagent.
