A bill for an act
relating to employment; assessing civil and criminal penalties for employment
of illegal immigrants; proposing coding for new law in Minnesota Statutes,
chapter 609.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) The definitions in this subdivision apply to this
section.

(b) "Employer" means any person having one or more employees in Minnesota and
includes the state and any political subdivision of the state.

(c) "Illegal immigrant" means a person who is in the United States illegally under
United States Code, title 8, chapter 12, or a person who lacks employment authorization in
the United States, or both.

(a) An employer who knowingly hires, recruits, or refers
an illegal immigrant for employment in Minnesota is subject to the penalties in this
subdivision.

(b) The commissioner of labor and industry may assess a fine of $10,000 for each
illegal immigrant employed.

(c) If an employer has been fined under this section previously, the commissioner of
labor and industry may assess a fine of $50,000 for each illegal immigrant employed.

An employer who is subject to the fine in subdivision 2,
paragraph (c), is guilty of a gross misdemeanor.
