  1.1                          A bill for an act 
  1.2             relating to the University of Minnesota; extending 
  1.3             competitive bidding and prompt payment requirements to 
  1.4             the University of Minnesota; amending Minnesota 
  1.5             Statutes 2000, sections 16A.124, subdivision 1; 
  1.6             16C.02, subdivision 2; 16C.25. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2000, section 16A.124, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [DEFINITIONS.] For the purposes of this 
  1.11  section, the following terms have the meanings here given them.  
  1.12     (a) "Commissioner" means the commissioner of finance.  
  1.13     (b) "State agency" has the meaning assigned to it in 
  1.14  section 16B.01 and, in addition, includes the University of 
  1.15  Minnesota.  
  1.16     Sec. 2.  Minnesota Statutes 2000, section 16C.02, 
  1.17  subdivision 2, is amended to read: 
  1.18     Subd. 2.  [AGENCY.] "Agency" means any state officer, 
  1.19  employee, board, commission, authority, department, entity, or 
  1.20  organization of the executive branch of state government.  
  1.21     Unless specifically provided elsewhere in this chapter, 
  1.22  agency "agency" does not include the Minnesota state colleges 
  1.23  and universities.  Except as specifically provided elsewhere in 
  1.24  this chapter, "agency" does include the University of Minnesota 
  1.25  for the purposes of contracts the university proposes to enter 
  1.26  into where funds appropriated by the legislature will be 
  2.1   expended in connection with those contracts. 
  2.2      Sec. 3.  Minnesota Statutes 2000, section 16C.25, is 
  2.3   amended to read: 
  2.4      16C.25 [BUILDING AND CONSTRUCTION CONTRACTS.] 
  2.5      (a) Notwithstanding any contrary law, the provisions of 
  2.6   Minnesota Statutes 1996, section 16B.07, 16B.08, 16B.09, and all 
  2.7   other laws applicable to competitive bidding for building and 
  2.8   construction contracts on June 30, 1998, apply to building and 
  2.9   construction contracts entered into on or after July 1, 1998. 
  2.10     (b) Paragraph (a) applies to all projects undertaken by the 
  2.11  University of Minnesota involving the demolition of, or 
  2.12  construction of improvements to, real property.
