A bill for an act
relating to human services; enacting Hannah's Law by modifying
cardiopulmonary resuscitation requirements for child care center staff; amending
Minnesota Statutes 2010, section 245A.40, subdivision 4.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

This act may be cited as "Hannah's Law."

Minnesota Statutes 2010, section 245A.40, subdivision 4, is amended to read:
(a) deleted text begin When children are presentdeleted text end new text begin All
teachers and assistant teachers new text end in a child care center governed by Minnesota Rules, parts
9503.0005 to 9503.0170, new text begin and new text end at least one staff person deleted text begin must be present in the center
who has been traineddeleted text end new text begin during field trips and when transporting children in care, must
satisfactorily complete training new text end in cardiopulmonary resuscitation (CPR) and in the
treatment of obstructed airwaysnew text begin that includes CPR techniques for infants and children. The
CPR training must be completed within 90 days of the start of work, unless the training
has been completed within the previous three yearsnew text end . The CPR training must have been
provided by an individual approved to provide CPR instruction, must be repeated at least
once every three years, and must be documented in the staff person's records.
(b) CPR training may be provided for less than four hours.
(c) deleted text begin Persons qualified to provide CPR training shall include individuals approved as
CPR instructors.deleted text end new text begin Persons providing CPR training must use CPR training that has been
developed:

(1) by the American Heart Association or the American Red Cross and incorporates
psychomotor skills to support the instruction; or

(2) using nationally recognized, evidence-based guidelines for CPR and incorporates
psychomotor skills to support the instruction.
