  1.1                          A bill for an act 
  1.2             relating to education; providing that high school 
  1.3             pupils enrolled in post-secondary courses may 
  1.4             participate in high school activities; excluding 
  1.5             grades earned in a post-secondary course from a 
  1.6             pupil's grade point average and class rank in a 
  1.7             secondary school; amending Minnesota Statutes 1996, 
  1.8             section 123.3514, subdivision 5; and by adding a 
  1.9             subdivision. 
  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11     Section 1.  Minnesota Statutes 1996, section 123.3514, is 
  1.12  amended by adding a subdivision to read: 
  1.13     Subd. 4f.  [PARTICIPATION IN HIGH SCHOOL ACTIVITIES.] A 
  1.14  school district shall not prohibit a pupil enrolled in a course 
  1.15  under this section from participating in activities sponsored by 
  1.16  the pupil's high school, including, but not limited to, 
  1.17  extracurricular academic activities, athletics, student 
  1.18  government, and school clubs and organizations. 
  1.19     Sec. 2.  Minnesota Statutes 1996, section 123.3514, 
  1.20  subdivision 5, is amended to read: 
  1.21     Subd. 5.  [CREDITS.] A pupil may enroll in a course under 
  1.22  this section for either secondary credit or post-secondary 
  1.23  credit.  At the time a pupil enrolls in a course, the pupil 
  1.24  shall designate whether the course is for secondary or 
  1.25  post-secondary credit.  A pupil taking several courses may 
  1.26  designate some for secondary credit and some for post-secondary 
  1.27  credit.  A pupil must not audit a course under this section. 
  2.1      A school district shall grant academic credit to a pupil 
  2.2   enrolled in a course for secondary credit if the pupil 
  2.3   successfully completes the course.  Seven quarter or four 
  2.4   semester college credits equal at least one full year of high 
  2.5   school credit.  Fewer college credits may be prorated.  A school 
  2.6   district shall also grant academic credit to a pupil enrolled in 
  2.7   a course for post-secondary credit if secondary credit is 
  2.8   requested by a pupil.  If no comparable course is offered by the 
  2.9   district, the district shall, as soon as possible, notify the 
  2.10  commissioner, which shall determine the number of credits that 
  2.11  shall be granted to a pupil who successfully completes a 
  2.12  course.  If a comparable course is offered by the district, the 
  2.13  school board shall grant a comparable number of credits to the 
  2.14  pupil.  If there is a dispute between the district and the pupil 
  2.15  regarding the number of credits granted for a particular course, 
  2.16  the pupil may appeal the school board's decision to the 
  2.17  commissioner.  The commissioner's decision regarding the number 
  2.18  of credits shall be final.  
  2.19     The secondary credits granted to a pupil shall be counted 
  2.20  toward the graduation requirements and subject area requirements 
  2.21  of the school district.  Evidence of successful completion of 
  2.22  each course and secondary credits granted shall be included in 
  2.23  the pupil's secondary school record.  A pupil must provide the 
  2.24  school with a copy of the pupil's grade in each course taken for 
  2.25  secondary credit under this section.  A pupil's grade in a 
  2.26  course taken at a post-secondary institution exclusively for 
  2.27  post-secondary credit shall not be considered in the 
  2.28  determination of the pupil's grade point average and class rank 
  2.29  at the pupil's secondary school.  Upon the request of a pupil, 
  2.30  the pupil's secondary school record shall also include evidence 
  2.31  of successful completion and credits granted for a course taken 
  2.32  for post-secondary credit.  In either case, the record shall 
  2.33  indicate that the credits were earned at a post-secondary 
  2.34  institution. 
  2.35     If a pupil enrolls in a post-secondary institution after 
  2.36  leaving secondary school, the post-secondary institution shall 
  3.1   award post-secondary credit for any course successfully 
  3.2   completed for secondary credit at that institution.  Other 
  3.3   post-secondary institutions may award, after a pupil leaves 
  3.4   secondary school, post-secondary credit for any courses 
  3.5   successfully completed under this section.  An institution may 
  3.6   not charge a pupil for the award of credit.
