  1.1                          A bill for an act 
  1.2             relating to retirement; excluding certain persons and 
  1.3             entities from state pension funds; amending Minnesota 
  1.4             Statutes 1994, section 353.01, subdivision 6; 
  1.5             Minnesota Statutes 1995 Supplement, section 352.01, 
  1.6             subdivision 2a; repealing Minnesota Statutes 1994, 
  1.7             section 353.64, subdivision 9. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1995 Supplement, section 
  1.10  352.01, subdivision 2a, is amended to read: 
  1.11     Subd. 2a.  [INCLUDED EMPLOYEES.] (a) "State employee" 
  1.12  includes: 
  1.13     (1) employees of the Minnesota historical society; 
  1.14     (2) employees of the state horticultural society; 
  1.15     (3) employees of the Disabled American Veterans, Department 
  1.16  of Minnesota, Veterans of Foreign Wars, Department of Minnesota, 
  1.17  if employed before July 1, 1963; 
  1.18     (4) employees of the Minnesota crop improvement 
  1.19  association; 
  1.20     (5) employees of the adjutant general who are paid from 
  1.21  federal funds and who are not covered by any federal civilian 
  1.22  employees retirement system; 
  1.23     (6) (5) employees of the state universities employed under 
  1.24  the university activities program; 
  1.25     (7) (6) currently contributing employees covered by the 
  1.26  system who are temporarily employed by the legislature during a 
  2.1   legislative session or any currently contributing employee 
  2.2   employed for any special service as defined in clause (8) of 
  2.3   subdivision 2b; 
  2.4      (8) employees of the armory building commission; 
  2.5      (9) (7) permanent employees of the legislature and persons 
  2.6   employed or designated by the legislature or by a legislative 
  2.7   committee or commission or other competent authority to conduct 
  2.8   a special inquiry, investigation, examination, or installation; 
  2.9      (10) (8) trainees who are employed on a full-time 
  2.10  established training program performing the duties of the 
  2.11  classified position for which they will be eligible to receive 
  2.12  immediate appointment at the completion of the training period; 
  2.13     (11) (9) employees of the Minnesota safety council; 
  2.14     (12) (10) any employees on authorized leave of absence from 
  2.15  the transit operating division of the former metropolitan 
  2.16  transit commission who are employed by the labor organization 
  2.17  which is the exclusive bargaining agent representing employees 
  2.18  of the transit operating division; 
  2.19     (13) (11) employees of the metropolitan council, 
  2.20  metropolitan parks and open space commission, metropolitan 
  2.21  sports facilities commission, metropolitan mosquito control 
  2.22  commission, or metropolitan radio board unless excluded or 
  2.23  covered by another public pension fund or plan under section 
  2.24  473.415, subdivision 3; 
  2.25     (14) (12) judges of the tax court; and 
  2.26     (15) (13) personnel employed on June 30, 1992, by the 
  2.27  University of Minnesota in the management, operation, or 
  2.28  maintenance of its heating plant facilities, whose employment 
  2.29  transfers to an employer assuming operation of the heating plant 
  2.30  facilities, so long as the person is employed at the University 
  2.31  of Minnesota heating plant by that employer or by its successor 
  2.32  organization. 
  2.33     (b) Employees specified in paragraph (a), clause (15), are 
  2.34  included employees under paragraph (a) providing that employer 
  2.35  and employee contributions are made in a timely manner in the 
  2.36  amounts required by section 352.04.  Employee contributions must 
  3.1   be deducted from salary.  Employer contributions are the sole 
  3.2   obligation of the employer assuming operation of the University 
  3.3   of Minnesota heating plant facilities or any successor 
  3.4   organizations to that employer. 
  3.5      Sec. 2.  Minnesota Statutes 1994, section 353.01, 
  3.6   subdivision 6, is amended to read: 
  3.7      Subd. 6.  [GOVERNMENTAL SUBDIVISION.] (a) "Governmental 
  3.8   subdivision" means a county, city, town, school district within 
  3.9   this state, or a department or unit of state government, or any 
  3.10  public body whose revenues are derived from taxation, fees, 
  3.11  assessments, or from other sources. 
  3.12     (b) Governmental subdivision also means the public 
  3.13  employees retirement association, the league of Minnesota 
  3.14  cities, the association of metropolitan municipalities, public 
  3.15  hospitals owned or operated by, or an integral part of, a 
  3.16  governmental subdivision or governmental subdivisions, the 
  3.17  association of Minnesota counties, the metropolitan intercounty 
  3.18  association, the Minnesota municipal utilities association, the 
  3.19  metropolitan airports commission, and the Minneapolis employees 
  3.20  retirement fund for employment initially commenced after June 
  3.21  30, 1979, the range association of municipalities and schools, 
  3.22  soil and water conservation districts, and economic development 
  3.23  authorities created or operating under sections 469.090 to 
  3.24  469.108. 
  3.25     (c) Governmental subdivision does not mean any municipal 
  3.26  housing and redevelopment authority organized under the 
  3.27  provisions of sections 469.001 to 469.047; or any port authority 
  3.28  organized under sections 469.048 to 469.068; or any hospital 
  3.29  district organized or reorganized prior to July 1, 1975, under 
  3.30  sections 447.31 to 447.37 or the successor of the district, nor 
  3.31  the Minneapolis community development agency.  
  3.32     Sec. 3.  [REPEALER.] 
  3.33     Minnesota Statutes 1994, section 353.64, subdivision 9, is 
  3.34  repealed.
