A bill for an act
relating to highways; requiring highways constructed,
reconstructed, or resurfaced wholly or partly with
federal or state funds to be constructed to a ten-ton
standard with certain exceptions; proposing coding for
new law in Minnesota Statutes, chapter 160.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin When the construction,
reconstruction, or resurfacing of the roadway of a trunk
highway, county state-aid highway, or municipal state-aid street
is financed in whole or in part with federal or state funds, the
road authority must construct, reconstruct, or resurface the
roadway to a standard that allows the operation of vehicles with
a gross weight on any single axle of up to 20,000 pounds,
including operation during periods of seasonal load restrictions
under section 169.87.

new text begin Subdivision 1 does not apply to the
construction, reconstruction, or resurfacing of:

new text begin (1) a federally designated or state-designated scenic
byway;
new text end

new text begin (2) a natural preservation route designated under section
162.021;
new text end

new text begin (3) a highway located in a national, state, regional, or
local park; or
new text end

new text begin (4) a gravel-surfaced road where the project does not
involve resurfacing with a hard surface.

new text begin At the conclusion of the project,
a road authority that has constructed, reconstructed, or
resurfaced a roadway subject to subdivision 1 must post that
roadway to allow operation of motor vehicles with axle weights
of up to 20,000 pounds, and may not post the roadway for any
lower weight except where necessary to prevent imminent damage
to the roadway or subsurface.
