  1.1                          A bill for an act
  1.2             relating to human services; modifying the calculation 
  1.3             of food stamp benefits for certain noncitizen 
  1.4             families; amending Laws 1997, chapter 85, article 1, 
  1.5             section 7, subdivision 2, as amended; repealing 
  1.6             Minnesota Statutes 1997 Supplement, section 256D.057. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Laws 1997, chapter 85, article 1, section 7, 
  1.9   subdivision 2, as amended by Laws 1997, chapter 203, article 12, 
  1.10  section 7, is amended to read: 
  1.11     Subd. 2.  [NONCITIZENS; FOOD PORTION.] (a) For the period 
  1.12  September 1, 1997, to June 30, 1998 October 31, 1997, 
  1.13  noncitizens who do not meet one of the exemptions in section 412 
  1.14  of the Personal Responsibility and Work Opportunity 
  1.15  Reconciliation Act of 1996, but were residing in this state as 
  1.16  of July 1, 1997, are eligible for the 6/10 of the average value 
  1.17  of food stamps for the same family size and composition until 
  1.18  MFIP-S is operative in the noncitizen's county of financial 
  1.19  responsibility and thereafter, the 6/10 of the food portion of 
  1.20  MFIP-S.  However, federal food stamp dollars cannot be used to 
  1.21  fund the food portion of MFIP-S benefits for an individual under 
  1.22  this subdivision.  
  1.23     (b) For the period November 1, 1997, to June 30, 1998, 
  1.24  noncitizens who do not meet one of the exemptions in section 412 
  1.25  of the Personal Responsibility and Work Opportunity 
  1.26  Reconciliation Act of 1996, but were residing in this state as 
  2.1   of July 1, 1997, and are receiving cash assistance under the 
  2.2   AFDC, family general assistance, MFIP or MFIP-S programs are 
  2.3   eligible for the average value of food stamps for the same 
  2.4   family size and composition until MFIP-S is operative in the 
  2.5   noncitizen's county of financial responsibility and thereafter, 
  2.6   the food portion of MFIP-S.  However, federal food stamp dollars 
  2.7   cannot be used to fund the food portion of MFIP-S benefits for 
  2.8   an individual under this subdivision.  The assistance provided 
  2.9   under this subdivision, which is designated as a supplement to 
  2.10  replace lost benefits under the federal food stamp program, must 
  2.11  be disregarded as income in all programs that do not count food 
  2.12  stamps as income where the commissioner has the authority to 
  2.13  make the income disregard determination for the program. 
  2.14     Sec. 2.  [REALLOCATION OF PREVIOUSLY APPROPRIATED FUNDS.] 
  2.15     For the fiscal year ending June 30, 1998, the appropriation 
  2.16  in Laws 1997, chapter 203, article 1, section 2, subdivision 10, 
  2.17  paragraph (f), for general assistance grants is reduced by 
  2.18  $1,090,000.  For the fiscal year ending June 30, 1998, the 
  2.19  $960,000 appropriation in Laws 1997, chapter 203, article 1, 
  2.20  section 2, subdivision 11, paragraph (b), is canceled.  
  2.21  $2,050,000 is appropriated to the commissioner for the purposes 
  2.22  of section 1. 
  2.23     Sec. 3.  [REPEALER.] 
  2.24     Minnesota Statutes 1997 Supplement, section 256D.057, is 
  2.25  repealed. 
  2.26     Sec. 4.  [EFFECTIVE DATE.] 
  2.27     Sections 1 to 3 are effective the day following final 
  2.28  enactment.
