352C.09; 352C.091, subdivisions 2, 3.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin [352C.001] RETIREMENT PLAN; APPLICATION.

new text begin (a) The retirement plan applicable to a former
constitutional officer who was first elected to a constitutional
office after July 1, 1967, and before July 1, 1997, is the
applicable portions of this chapter and chapter 356 in effect on
the date on which the person terminated active service as a
constitutional officer.

new text begin (b) Nothing in this section or section 2 or 3 is intended
to reduce the benefits of former constitutional officers or to
adversely modify their eligibility for benefits in effect as of
the day before the effective date of this section.

Sec. 2.

Minnesota Statutes 2004, section 352C.091,
subdivision 1, is amended to read:
