  1.1                          A bill for an act 
  1.2             relating to education; providing for state aid for 
  1.3             school transportation; amending Minnesota Statutes 
  1.4             1994, sections 123.39, subdivision 1; and 124.223, by 
  1.5             adding a subdivision; repealing Minnesota Statutes 
  1.6             1994, sections 123.37, subdivision 1b; 124.225, 
  1.7             subdivisions 1, 3a, 7a, 7b, 7d, 7e, 8a, 8k, 8m, and 
  1.8             10; and 124.226, subdivisions 1, 2, 3, 3a, 4, 5, 7, 8, 
  1.9             and 9. 
  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11     Section 1.  Minnesota Statutes 1994, section 123.39, 
  1.12  subdivision 1, is amended to read: 
  1.13     Subdivision 1.  (a) The board may shall provide for the 
  1.14  transportation of pupils to and from school and for any other 
  1.15  school-related purpose for which aid is authorized under section 
  1.16  124.223 or for which levies are authorized under sections 
  1.17  124.226, 124.2716, 124.91, 124.912, 124.914, 124.916, 124.918, 
  1.18  and 136C.411.  The board may also provide for the transportation 
  1.19  of pupils to schools in other districts for grades and 
  1.20  departments not maintained in the district, including high 
  1.21  school, at the expense of the district, when funds are available 
  1.22  therefor and if agreeable to the district to which it is 
  1.23  proposed to transport the pupils, for the whole or a part of the 
  1.24  school year, as it may deem advisable, and subject to its 
  1.25  rules.  In any school district, the board shall arrange for the 
  1.26  attendance of all pupils living two miles or more from the 
  1.27  school, except pupils whose transportation privileges have been 
  2.1   revoked under section 123.805, subdivision 1, clause (6), or 
  2.2   123.7991, paragraph (b), through suitable provision for 
  2.3   transportation or through the boarding and rooming of the pupils 
  2.4   who may be more economically and conveniently provided for by 
  2.5   that means.  The board shall provide transportation to and from 
  2.6   the home of a child with a disability not yet enrolled in 
  2.7   kindergarten when special instruction and services under 
  2.8   sections 120.17 and 120.1701 are provided in a location other 
  2.9   than in the child's home.  When transportation is provided, 
  2.10  scheduling of routes, establishment of the location of bus 
  2.11  stops, manner and method of transportation, control and 
  2.12  discipline of school children and any other matter relating 
  2.13  thereto shall be within the sole discretion, control, and 
  2.14  management of the school board.  The district may provide for 
  2.15  the transportation of pupils or expend a reasonable amount for 
  2.16  room and board of pupils whose attendance at school can more 
  2.17  economically and conveniently be provided for by that means or 
  2.18  who attend school in a building rented or leased by a district 
  2.19  within the confines of an adjacent district.  The district may 
  2.20  make reasonable arrangements to accommodate pupil transportation 
  2.21  needs for evening school activities. 
  2.22     (b) A pupil shall not drive a private vehicle to school 
  2.23  except when the pupil is employed after school, the school bus 
  2.24  schedule does not accommodate the pupil's work schedule, and a 
  2.25  written statement by the pupil's parent or guardian and employer 
  2.26  stating the pupil's need for private transportation to go to 
  2.27  work is on file at the school. 
  2.28     Sec. 2.  Minnesota Statutes 1994, section 124.223, is 
  2.29  amended by adding a subdivision to read: 
  2.30     Subd. 10a.  [LATE ACTIVITY BUSES.] State transportation aid 
  2.31  is authorized for late transportation home from school, between 
  2.32  schools within a district, or between schools in one or more 
  2.33  districts for pupils involved in after school activities. 
  2.34     Sec. 3.  [REPEALER.] 
  2.35     Minnesota Statutes 1994, sections 123.37, subdivision 1b; 
  2.36  124.225, subdivisions 1, 3a, 7a, 7b, 7d, 7e, 8a, 8k, 8m, and 10; 
  3.1   and 124.226, subdivisions 1, 2, 3, 3a, 4, 5, 7, 8, and 9, are 
  3.2   repealed.
