A bill for an act
relating to state government; enacting provisions relating to state agency hiring
and contracting under the American Recovery and Reinvestment Act of 2009;
requiring a report.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. AMERICAN RECOVERY AND REINVESTMENT ACT SPENDING.

(a) A state agency spending money received from the federal government under the
American Recovery and Reinvestment Act (ARRA) of 2009 must:

(1) to the extent the funds are used to hire employees, use these hiring opportunities
to the greatest extent possible to eliminate the underutilization of protected group members
in the agency's work force, as provided under affirmative action plans developed under
Minnesota Statutes, sections 43A.19 and 43A.191; and

(2) to the extent the funds are used to enter into contracts: (i) ensure that purchases
from targeted group business reflect a fair and equitable representation of the agency's
purchasing, as specified in Minnesota Statutes, sections 16C.16 and 16C.17; and (ii)
require each contractor that is hiring employees to perform work with money received
through the ARRA to use hiring opportunities to the greatest extent possible to eliminate
underutilization of protected group members in the contractor's work force.

(b) The commissioners of finance and administration must jointly report to the
legislature by January 15, 2010, and January 15, 2011, on each agency's expenditures on
hiring of employees and entering into contracts with money received under the American
Recovery and Reinvestment Act of 2009. For each agency and for the executive branch
in total the reports must indicate:

(1) the total number of employees hired and the number of employees hired from
each protected group; and

(2) the number and dollar value of contracts entered into, and the number and dollar
value of contracts entered into with each category of targeted group businesses.

EFFECTIVE DATE.

This section is effective the day following final enactment.
