A bill for an act
relating to consumer protection; regulating certain gasoline sales near terminals;
prescribing penalties; proposing coding for new law in Minnesota Statutes,
chapter 325D.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin A person, firm, company, association, or corporation, foreign or domestic, doing
business in this state as the owner and operator of both a gasoline terminal and two or
more retail locations offering the sale of gasoline by way of posted price or indicating
meter may not charge gasoline customers of the retail locations within seven miles of the
terminal more than the lowest price offered by any of the retail locations under the same
ownership located within 35 miles of the terminal.

new text begin A violation of this section is a violation of section 325D.67, except that the criminal
penalties in section 325D.67, subdivision 2, do not apply. In addition to the penalties
for violations and the remedies provided for injured parties set forth elsewhere in this
chapter, the commissioner of commerce may use the authority under section 45.027 for
the purpose of preventing violations of this section.
